【摘要】： 本文以明治舊民法典的編纂、論爭為主線,分析明治舊民法典延期實施的原因。明治舊民法典的編纂作為日本近代國家法制建設(shè)的重要一環(huán),備受關(guān)注。但是,其因何延期實施?是值得探究的。事物的因果聯(lián)系存在于事物的發(fā)展過程之中,舊民法典的編纂、論爭,蘊含著舊民法典延期實施的潛在因素,本文在于全面地深刻地揭示舊民法典延期實施的原因。 本文第一部分主要論述舊民法典的編纂過程。通過對舊民法典產(chǎn)生的社會動因的清晰把握,分析舊民法典的編纂過程和舊民法典的自身特點。 本文第二部分主要論述舊民法典的論爭過程。從舊民法典論爭的起因、以及論爭的史實,認識舊民法典論爭的實質(zhì)。舊民法典論爭的結(jié)果是舊民法典被延期實施。 本文的第三部分主要論述舊民法典延期實施的原因,是本文的核心部分。從舊民法典編纂的過程進行分析,認為“法典速成論”貫穿編纂的整個過程,這就決定了舊民法典具有先天不足之痹癥,而舊民法典與日本傳統(tǒng)社會關(guān)系的沖突是導致舊民法典延期實施的根本原因。
[Abstract]:Taking the compilation of Meiji Old Civil Code as the main line, this paper analyzes the reasons why Meiji Old Civil Code was postponed. The compilation of Meiji Old Civil Code, as an important part of the legal system construction of modern Japan, has attracted much attention. The compilation and controversy of the old civil code contain the potential factors for the extension of the implementation of the old civil code.
The first part of this article mainly discusses the compilation process of the old civil code, and analyzes the compilation process and the characteristics of the old civil code through a clear grasp of the social causes of the old civil code.
The second part of this article mainly discusses the controversial process of the old civil code.From the origin of the controversy of the old civil code and the historical facts of the controversy,we can understand the essence of the controversy of the old civil code.The result of the controversy of the old civil code is that the old civil code has been postponed.
The third part of this article mainly discusses the reasons for the postponement of the implementation of the old civil code, which is the core part of this article. From the analysis of the process of the compilation of the old civil code, it is concluded that "the theory of the rapid formation of the code" runs through the whole process of the compilation, which determines that the old civil code has the congenital insufficiency of the Bi syndrome. The root cause of the extension of the old civil code.
