【摘要】：我國(guó)刑釋人員社會(huì)保護(hù)工作仍面臨著觀念存在分歧、法律制度缺失、缺少統(tǒng)一的領(lǐng)導(dǎo)機(jī)構(gòu)、資金匱乏以及缺少民間力量的參與等諸多問(wèn)題。應(yīng)當(dāng)統(tǒng)一對(duì)刑釋人員社會(huì)保護(hù)的認(rèn)識(shí);加快刑釋人員社會(huì)保護(hù)立法進(jìn)程,科學(xué)確定立法內(nèi)容;將刑釋人員保護(hù)機(jī)構(gòu)與社區(qū)矯正機(jī)構(gòu)合并建設(shè),建立"國(guó)家參與型"刑釋人員社會(huì)保護(hù)機(jī)構(gòu),按照自主、自愿原則對(duì)刑釋人員實(shí)施保護(hù),創(chuàng)新刑釋人員社會(huì)保護(hù)的方法,完善刑釋人員社會(huì)保護(hù)的內(nèi)容。
[Abstract]:There are still many problems in the social protection of criminal release personnel in China, such as the lack of concept, the lack of legal system, the lack of unified leadership, the lack of funds and the lack of the participation of folk forces, and so on. We should unify the understanding of the social protection of the released criminal personnel, speed up the legislative process of the social protection of the released criminal personnel, scientifically determine the content of the legislation, and combine the construction of the protection institution of the released criminal personnel with the community correction institution. To establish the social protection institution of "state participation type" released criminal personnel, to protect them according to the principle of independence and voluntary, to innovate the method of social protection for the released criminal personnel, and to perfect the content of social protection for the released criminal personnel.
