【摘要】：目前我國學界存在關(guān)于法律體系理論有用和無用的爭論。此次爭論是一個人為制造且較為混亂的爭論,但是卻揭示了我國法律體系建構(gòu)中出現(xiàn)的問題——缺少理論。根據(jù)實踐與理論之間關(guān)系的內(nèi)在規(guī)定性,當代中國的法律體系構(gòu)建應當有法律體系理論的參與。我國法律體系建構(gòu)中缺少理論的原因在于對實踐與理論之間關(guān)系的錯誤認識——惟實踐主義傾向。
[Abstract]:At present, there are arguments about the usefulness and uselessness of the theory of legal system in Chinese academic circles. The controversy is a man-made and chaotic one, but it reveals the problem in the construction of our legal system-the lack of theory. According to the inherent regulation of the relationship between practice and theory, the construction of legal system in contemporary China should involve the theory of legal system. The reason for the lack of theory in the construction of our legal system lies in the wrong understanding of the relationship between practice and theory-but the tendency of pragmatism.
