【摘要】：本文利用框架理論,從靜態(tài)和動(dòng)態(tài)兩個(gè)角度分析法庭審判話語。靜態(tài)分析把法庭審判話語框架分為顯性和隱形兩種,并揭示框架的層級性和結(jié)構(gòu)性。顯性框架涉及程序正義,隱形框架涉及實(shí)體正義。動(dòng)態(tài)分析揭示法庭審判參與者的框架建構(gòu),認(rèn)為法庭審判本質(zhì)上是框架互動(dòng),特別是目的框架和故事框架的互動(dòng)。
[Abstract]:Based on the frame theory, this paper analyzes the trial discourse from the static and dynamic perspectives. The static analysis divides the discourse frame of court trial into two kinds: explicit and invisible, and reveals the hierarchy and structure of the framework. Explicit framework involves procedural justice, while invisible frame involves substantive justice. The dynamic analysis reveals the frame construction of court trial participants, and holds that court trial is essentially framework interaction, especially the interaction between purpose frame and story frame.
