論法律的現代性

【摘要】: 本文主要是在思想史的脈絡中,從知識傳統(tǒng)的斷裂入手,考察法律現代性作為一種有別于傳統(tǒng)知識的知識形態(tài)是如何自我確證、自我展現并呈現出其對現實的批判力的。筆者探討了法律現代性問題域中的一個重要問題,即現代法律主體與現代法律文本之間的理性互動,通過對現代法律文本的建構過程和現代法律主體自我身份型塑過程的考察,筆者發(fā)現“理性”是貫穿現代法律始終的核心價值要素!袄硇浴辈坏嬃爽F代社會的支配性價值原則即“主體性”原則,還成為現代形式法范式的靈魂所在。通過考察自宗教改革以來現代知識形態(tài)、政治哲學和法律的發(fā)展過程,我們可以看到一幅形式理性改造世界的世俗化的社會圖景。當筆者回顧了作為現代法律價值基礎的“理性”與“自由”是如何從抽象的理念現實化為具體的制度形態(tài)時,也同時體會到了“理性化”的法律是如何同“合理化”的社會生活展開互動的,F代形式化的法律與日益理性化的社會生活之間的反復磨合和互動,為我們展現了法律現代化的歷史過程。任何一種理論形態(tài)在發(fā)展到高度成熟的時候都會暴露出這樣那樣的問題,作為法律現代性重要表現形態(tài)的現代法治在“工具理性”不斷擴張的社會背景下,逐漸浮現出各種各樣的內在矛盾和沖突。理性的展現不斷地壓縮社會主體個人自由的空間,合理化的過程使形式合理性壓制實質合理性,導致價值和規(guī)范無法通過獲得理性證明而存在,現代法律正當性的根據也因為理性的內在缺陷而變得可疑了。為了重新塑造現代政治和法律的規(guī)范性基礎,對現有的理性模式進行批判并尋找替代性的理性模式就成為一種必然的選擇了。哈貝馬斯用“主體間性”的“溝通理性”替代了日益“工具化”的“主體理性”,為現代性的法律提供了一種新的規(guī)范性基礎,也為現代法律的發(fā)展提供了一條新的路徑。
[Abstract]:In the context of the history of thought, this paper examines how legal modernity, as a form of knowledge different from traditional knowledge, confirms itself, reveals itself and presents its critical power to reality from the breakage of knowledge tradition. The author probes into an important problem in the field of legal modernity, that is, the rational interaction between the modern legal subject and the modern legal text, through the investigation of the construction process of the modern legal text and the self-identity molding process of the modern legal subject. The author finds that rationality is the core value of modern law. Rationality not only constructs the dominant value principle of modern society, that is, the principle of subjectivity, but also becomes the soul of the paradigm of modern formal law. By examining the development process of modern knowledge form, political philosophy and law since the religious reform, we can see a secularized social picture of the transformation of the world with formal rationality. When the author reviews how "rationality" and "freedom", as the foundation of modern legal value, are transformed from abstract ideas into concrete institutional forms, At the same time, I realized how the rational law interacts with the rational social life. The repeated run-in and interaction between the modern formalized law and the increasingly rational social life show us the historical process of legal modernization. Any kind of theoretical form will expose some problems when it develops to a high degree of maturity. The modern rule of law, as an important manifestation of legal modernity, is under the social background of "instrumental rationality" expanding constantly. A variety of internal contradictions and conflicts emerge gradually. The rational display constantly compresses the space of the individual freedom of the social subject, the rationalization process causes the form rationality to suppress the substantive rationality, causes the value and the norm to be unable to obtain the rational proof and exists, The basis of the legitimacy of modern law has become doubtful because of the inherent defects of reason. In order to remodel the normative foundation of modern politics and law, it is an inevitable choice to criticize the existing rational model and find alternative rational model. Habermas has replaced the increasingly "instrumental" subjective rationality "with the" inter-subjectivity "communication rationality", which provides a new normative basis for modern law and a new path for the development of modern law.
