侗族的婚姻關(guān)系與習(xí)慣法研究

【摘要】: 侗族是中國南部具有悠久歷史、勤勞勇敢的稻作民族。長期以來,由于社會、經(jīng)濟(jì)、文化等因素的影響,侗族在婚姻和家庭制度上形成了具有民族特色的習(xí)慣法,它既非純粹的法律規(guī)范,也不是完全的道德規(guī)范,但是它又是具有強(qiáng)制性和習(xí)慣性的社會規(guī)范,并在維護(hù)民族整體利益、保障民族內(nèi)部秩序、促進(jìn)民族安定發(fā)展、傳遞民族特色文化方面起著積極的作用。 本文以侗族婚姻關(guān)系領(lǐng)域的通行習(xí)慣法為研究對象,分析、描述侗族傳統(tǒng)婚姻關(guān)系與習(xí)慣法的基本內(nèi)容及其歷史嬗變,并在此基礎(chǔ)上思考侗族婚姻習(xí)慣法的合理內(nèi)核和功能及當(dāng)代發(fā)展問題,同時通過對侗族婚姻習(xí)慣法和國家婚姻法沖突的論述,試圖尋找解決少數(shù)民族婚姻習(xí)慣法與國家法的沖突問題的可取之道。 國內(nèi)學(xué)界對于侗族習(xí)慣法的研究成果頗豐,但在傳統(tǒng)婚姻關(guān)系領(lǐng)域還比較薄弱。本文在進(jìn)行侗族傳統(tǒng)婚姻關(guān)系與習(xí)慣法的探討時,秉承法律多元的理念,堅(jiān)持歷史進(jìn)化與整體聯(lián)系的觀點(diǎn),運(yùn)用辯證唯物主義和歷史唯物主義的基本方法,以法學(xué)和歷史學(xué)相結(jié)合的方法為主,同時借鑒民族學(xué)、倫理學(xué)、社會學(xué)等學(xué)科的理論和方法,進(jìn)行綜合研究。從而,試圖描述侗族婚姻習(xí)慣法的歷史狀態(tài),把握其近現(xiàn)代變遷的趨勢及本質(zhì),并思考其當(dāng)代發(fā)展問題,體現(xiàn)對其的現(xiàn)實(shí)關(guān)照,以彰顯侗族婚姻習(xí)慣法在法人類學(xué)和法社會學(xué)上的理論價值;同時本文對于加強(qiáng)民族地區(qū)民主法制建設(shè)和解決少數(shù)民族婚姻習(xí)慣法與國家法的沖突與調(diào)適問題,具有一定的參考價值。 除引言和結(jié)語外,文章分為四部分: 第一部分介紹侗族的分布、族稱、族源和民族形成等問題,并概括描述了侗族習(xí)慣法的基本內(nèi)容,為后文起到鋪墊作用。第二部分著重講述侗族傳統(tǒng)婚姻關(guān)系與習(xí)慣法的歷史狀態(tài),分成五個方面:戀愛習(xí)俗、通婚范圍、婚姻的締結(jié)、婚姻的終結(jié)與再婚、懲戒及罰則。第三部分論述侗族婚姻習(xí)慣法近代變革和現(xiàn)代變遷,以期把握其變化發(fā)展的趨勢與實(shí)質(zhì)。本文最后部分是對侗族婚姻習(xí)慣法的一些思考,通過尋找其內(nèi)在合理性及功能,描述侗族婚姻習(xí)慣法和國家婚姻法的沖突的表現(xiàn)和原因,思索其當(dāng)代發(fā)展問題,并試圖加以改造,使之適合當(dāng)代文明社會的發(fā)展。
[Abstract]:Dong nationality is a rice farming nation with a long history and hard-working and brave in the south of China. For a long time, due to the influence of social, economic, cultural and other factors, the Dong nationality has formed the customary law with national characteristics in the marriage and family system, which is neither a pure legal norm nor a complete moral norm. However, it is a mandatory and customary social norm, which plays an active role in safeguarding the overall interests of the nation, ensuring the internal order of the nation, promoting the stable development of the nation and transmitting the culture with national characteristics. This paper takes customary law in the field of marriage relationship of Dong nationality as the research object, analyzes and describes the basic content and historical evolution of the traditional marriage relationship and customary law of Dong nationality. On this basis, the author thinks about the reasonable core and function of the customary law of marriage of Dong nationality and its contemporary development, and at the same time discusses the conflict between the customary law of marriage of Dong nationality and the law of marriage of the state. This paper tries to find a solution to the conflict between customary law and national law. There are many researches on customary law of Dong nationality in China, but it is still weak in the field of traditional marriage. In the discussion of the traditional marriage relationship and customary law of Dong nationality, this paper adheres to the concept of legal pluralism, insists on the viewpoint of historical evolution and overall connection, and applies the basic methods of dialectical materialism and historical materialism. The method of combining law with history and drawing lessons from the theories and methods of ethnology, ethics and sociology are used for comprehensive research. Thus, this paper attempts to describe the historical state of customary law of marriage of Dong nationality, to grasp the trend and essence of its modern changes, and to reflect on its contemporary development and reflect on its realistic care. In order to show the theoretical value of the customary law of marriage of Dong nationality in legal anthropology and sociology of law, at the same time, this paper will strengthen the construction of democracy and legal system in minority areas and resolve the conflict and adjustment between customary law of marriage of minority nationality and state law. It has certain reference value. In addition to the introduction and conclusion, the article is divided into four parts: the first part introduces the distribution of Dong nationality, clan name, ethnic origin and the formation of ethnic groups, and describes the basic content of customary law of Dong nationality. The second part focuses on the historical status of traditional marriage relationship and customary law of Dong nationality, which is divided into five aspects: love custom, intermarriage scope, marriage conclusion, marriage termination and remarriage, punishment and punishment. The third part discusses the modern change and modern change of the customary law of marriage of Dong nationality in order to grasp the trend and essence of its change and development. In the last part of this paper, some reflections on the customary law of marriage of Dong nationality are given. By looking for its internal rationality and function, the author describes the manifestation and reason of conflict between customary law of marriage of Dong nationality and the law of marriage of the state, and thinks about its contemporary development. And try to reform, make it suitable for the development of contemporary civil society.
