【摘要】：宋代社會,契約文書伴隨著土地私有制的深化及土地權利的分離,廣泛地應用于百姓的日常生活中。與此同時,"干照"作為"田宅訴訟"中各類契約文書的通稱,也因其具有示信、客觀真實的證據(jù)作用而成為宋代司法判詞的常用語。"干照"是宋代社會及司法活動中的固有詞匯,它真實地反映著唐宋的社會變革,把它作為一個有意義的語言符號置于宋代社會結構的網(wǎng)絡中,其背后反映的是宋代司法結構的變化與司法傳統(tǒng)的轉型。
[Abstract]:In Song Dynasty, with the deepening of private ownership of land and the separation of land rights, contract documents were widely used in people's daily life. At the same time, "dry Zhao", as a general term of various kinds of contract documents in "Tianzhai Litigation", has also become a common term in the judicial judgments of the Song Dynasty because of its signification and objective and truthful evidential role. " "Qianzhao" is an inherent term in the social and judicial activities of the Song Dynasty. It truly reflects the social changes in the Tang and Song dynasties and puts it as a meaningful linguistic symbol in the social structure of the Song Dynasty. It reflects the change of judicial structure and the transformation of judicial tradition in Song Dynasty.
