【摘要】： 我國(guó)現(xiàn)已開(kāi)展的法律績(jī)效評(píng)估是一種自上而下由立法機(jī)關(guān)進(jìn)行的內(nèi)部評(píng)估。這種評(píng)估方式對(duì)改善立法質(zhì)量,提高法律績(jī)效有一定的促進(jìn)作用,但往往容易出現(xiàn)立法部門(mén)滿意而公民不滿意的尷尬局面。立法不僅是立法機(jī)關(guān)的事,更是關(guān)乎全體公民切身利益的大事,立法不僅要立法部門(mén)、政府滿意,更需要普通公民的滿意,因?yàn)楣癫攀欠ㄖ沃黧w。近幾年,一些地方開(kāi)展了法律績(jī)效評(píng)估活動(dòng),但在理論和制度空白的情況下,公民評(píng)估主體地位的缺失、評(píng)估指標(biāo)混亂、評(píng)估方法落后、評(píng)估結(jié)果往往流于形式,在實(shí)踐中的價(jià)值也受到質(zhì)疑。 本文正是在這一背景下,.對(duì)法律績(jī)效的公民滿意度評(píng)估作了比較系統(tǒng)的研究。從公民滿意度評(píng)估基本理論著手,根據(jù)發(fā)達(dá)國(guó)家法律績(jī)效的公民滿意度評(píng)估的制度經(jīng)驗(yàn)和我國(guó)法律績(jī)效評(píng)估實(shí)踐,探索了法律績(jī)效的公民滿意度評(píng)估的指標(biāo)體系和具體的評(píng)估方法,最后提出了在我國(guó)建立法律績(jī)效的公民滿意度評(píng)估制度的構(gòu)想。既有理論分析,也有具體實(shí)踐操作和制度構(gòu)建,為法律績(jī)效的公民滿意度評(píng)估提供了較為全面和完整的技術(shù)支持和可靠的質(zhì)量保障。 另外,本文提出了法律績(jī)效評(píng)估必須以公民為中心,以公民需求為導(dǎo)向,才能為公民提供合法科學(xué)優(yōu)質(zhì)的法律法規(guī),確立以公民為本位的法律績(jī)效評(píng)估制度,把公民滿意度作為法律績(jī)效評(píng)估的核心指標(biāo)和終極標(biāo)準(zhǔn)。同時(shí)明確了公民不僅是法律績(jī)效評(píng)估的主體,也是提高立法質(zhì)量,推動(dòng)法治建設(shè)的主導(dǎo)力量。更重要的是,公民可以參與到立法機(jī)關(guān)對(duì)績(jī)效目標(biāo)的制定和績(jī)效創(chuàng)造中,體現(xiàn)了“以人為本”和“公民參與”的理念,對(duì)提升立法的科學(xué)性、民主性和合法性具有重大意義。 我國(guó)法律績(jī)效的公民滿意度評(píng)估無(wú)論在理論中還是制度實(shí)踐中都屬于新生事物。所以對(duì)其進(jìn)行理論探討和制度建構(gòu)則顯得尤為必要和及時(shí),這對(duì)于提升立法質(zhì)量,提高法律績(jī)效乃至法治國(guó)家的形成,建立回應(yīng)性、責(zé)任化、服務(wù)型的公民滿意的民主法治政府以及構(gòu)建和諧社會(huì)均具有極其重要的理論和實(shí)踐意義。
[Abstract]:The legal performance evaluation in China is a kind of internal evaluation from top to bottom by the legislature. This evaluation method has a certain effect on improving the quality of legislation and improving the legal performance, but it is often easy to appear in the embarrassing situation of the legislative department and the dissatisfaction of the citizens. For all the vital interests of the citizens, the legislation not only requires the legislative department, the government is satisfied, but also needs the satisfaction of the ordinary citizens, because the citizen is the subject of the rule of law. In recent years, some places have carried out the legal performance evaluation activities, but in the absence of the theory and system, the status of the citizen evaluation is missing, the evaluation index is confused and the evaluation method is used. Lagging behind, assessment results tend to be formalistic, and their value in practice is also questioned.
Under this background, this paper makes a systematic research on the evaluation of citizen satisfaction of legal performance. From the basic theory of citizen satisfaction assessment, the system experience of citizen satisfaction evaluation in the developed countries and the practice of China's legal performance evaluation, the index of citizen satisfaction evaluation of legal performance is explored. The system and the specific evaluation methods finally put forward the idea of establishing the citizen satisfaction evaluation system of legal performance in our country. It has both theoretical analysis, practical operation and system construction, which provides comprehensive and complete technical support and reliable quality guarantee for the evaluation of citizen satisfaction of legal performance.
In addition, this paper puts forward that legal performance evaluation must be centered on citizens and guided by citizen needs to provide citizens with legal and scientific and quality laws and regulations, to establish a legal performance evaluation system based on citizens, and to take citizen satisfaction as a core index and ultimate standard for the evaluation of legal performance. It is the main body of the legal performance evaluation, and it is also the leading force to improve the quality of legislation and promote the construction of the rule of law. More importantly, citizens can participate in the legislature in the formulation of performance goals and the creation of performance, which embodies the concept of "people-oriented" and "citizen participation", and is important to improve the scientificity, democracy and legitimacy of the legislation. Great significance.
The citizen satisfaction evaluation of the legal performance of our country belongs to the new things both in theory and in the system practice. Therefore, it is particularly necessary and timely to carry out theoretical discussion and system construction, which is to promote the quality of the legislation, improve the legal performance and even the form of the rule of law, and establish a responsive, responsible, and service-oriented citizen. Satisfactory democratic rule of law and harmonious society are of great theoretical and practical significance.
