【摘要】：正犯罪存留養(yǎng)親作為傳統(tǒng)中國(guó)法律的一項(xiàng)特殊制度,主要是為了解決徒、流及死刑犯的犯親老疾無(wú)人侍養(yǎng)問(wèn)題。在存留養(yǎng)親之下,即使死罪犯人也能獲得免刑,奉養(yǎng)年老有疾的父母、祖父母。正如《刑案匯覽》所言:"查犯罪存留養(yǎng)親,原系法外之仁,非為兇犯開(kāi)幸免之門(mén),實(shí)以慰犯親
