【摘要】：美國《信息自由法》對個人隱私信息的免除公開作了明確具體的限制性規(guī)定。聯(lián)邦法院在司法實(shí)踐中形成了認(rèn)定個人隱私權(quán)利益三個方面的標(biāo)準(zhǔn):存在因果關(guān)系;是特定個人的隱私權(quán);隱私權(quán)排除當(dāng)事人本人。同時形成了權(quán)衡隱私權(quán)利益與公共利益需考量的要素:對個人隱私權(quán)威脅程度;公開獲得的公共利益;獲取申請信息的替代方案。
[Abstract]:The Freedom of Information Act of the United States makes specific restrictions on the exemption from disclosure of personal privacy information. In the judicial practice, the Federal Court has formed the standards of identifying the interests of the individual privacy in three aspects: causality; the privacy of a particular individual; and the exclusion of the right to privacy from the parties themselves. At the same time, it forms the factors that should be considered in balancing the interests of privacy and the public interest: the degree of threat to personal privacy; the public interest obtained openly; and the alternative scheme for obtaining application information.
