【摘要】： “法官的判決是怎樣形成的?”,這個人類追問了數(shù)千年的問題,看起來似乎并不是那么的復雜,因為在世界各地的數(shù)以萬計的法院中,每天都進行著大量的決定案件的工作。但當我們以理性的、探究的目光來考問這個過程的時候,我們會發(fā)現(xiàn)它是那么的隱晦與難以把握,它不但涉及到法律的、語言的、思維的知識,而且還包含著對政策、時代精神、與人性的確認。就如美國大法官卡多佐所言的那樣:“任何法官都會認為可以很容易地描述他沿襲了成千上萬次的司法決定的過程。然而,沒有比這離事實真相更為遙遠的了�！� 本文正是沿著這樣的追問,考量司法過程中最有爭議但又最具有特色、最令人關(guān)注的法律推理問題。文章著重討論了法律推理中的實質(zhì)推導,以期解決的問題是當法律自身出現(xiàn)不清晰、混亂或者面對復雜的社會關(guān)系而“沉默”等等法律不確定的情形時,理性之光是如何重新照亮法律的天空。質(zhì)言之就是在法律的適用過程中,法律出現(xiàn)了各種不健全情況的時候,我們是怎樣尋找到合理的法律規(guī)范的。文章對實質(zhì)推導的一些主要問題做了一定的闡述與研究,嘗試揭示了一個以實質(zhì)推導的涵義、實質(zhì)推導的規(guī)則、實質(zhì)推導的模式等為主要內(nèi)容的實質(zhì)推導過程。希望對法律推理問題做出一些理論與實踐方面的探索。
[Abstract]:"how did the judge's decision come into being?" the human question, which has been asked for thousands of years, doesn't seem to be that complicated, because in tens of thousands of courts around the world, there are a lot of decisions going on every day. But when we look at the process from a rational, exploratory perspective, we find that it is so obscure and difficult to grasp. It involves not only knowledge of law, language, thinking, but also policy. The spirit of the times, and the confirmation of human nature. As U.S. Justice Cardoso put it: "any judge would think it easy to describe his process of following thousands of judicial decisions. However, there is nothing more distant from the truth. " This paper follows this kind of questioning to consider the most controversial, characteristic and most interesting legal reasoning in the judicial process. This paper focuses on the substantive derivation in legal reasoning, in order to solve the problem when the law itself appears unclear, confused or "silent" in the face of complex social relations, and so on. How the light of reason relights the sky of law. In short, how do we find reasonable legal norms in the process of application of law, when there are various imperfect situations in the law. In this paper, some main problems of substantive derivation are expounded and studied to some extent, and an attempt is made to reveal a substantial derivation process with the meaning of substantive derivation, the rules of substantive derivation, the mode of substantive derivation, and so on. I hope to make some theoretical and practical exploration on legal reasoning.
