【摘要】：源自《巴比倫塔木德》的著名法律箴言——"王國之法便是法",經(jīng)過許多拉比的討論辯駁,逐漸發(fā)展成為散居猶太人處理與非猶太人關(guān)系的基本準(zhǔn)則之一。一方面,它明確了散居猶太人對于居住國的義務(wù),作為所在地域的居民,應(yīng)當(dāng)像本地人一樣尊重屬地權(quán)威、承擔(dān)納稅職責(zé);另一方面,所在國的權(quán)威又是有限的,一旦超出某種限度或與猶太律法相沖突,它便不再是法。這種準(zhǔn)則的實(shí)質(zhì),是為維持猶太社團(tuán)而向外邦權(quán)威作必要的妥協(xié)。與其說它是一項(xiàng)法律準(zhǔn)則,毋寧說是一種生存策略。
[Abstract]:From Babylonian Talmud, a famous legal maxim, "the Law of the Kingdom is the Law", has gradually developed into one of the basic principles of dealing with non-Jews by the Jewish diaspora. On the one hand, it clarifies the obligation of the diaspora to the country of residence, and as a resident of the territory, it should respect the territorial authority and assume the duty to pay taxes as the natives do; on the other hand, the authority of the host country is limited. Once beyond a certain limit or in conflict with Jewish law, it is no longer a law. The essence of this norm is to make the necessary compromises to the authority of the Gentiles in order to maintain the Jewish community. It is not so much a legal norm as a survival strategy.
