我國立法后評估指標(biāo)體系的構(gòu)建

【摘要】: 傳統(tǒng)的立法理論重視立法過程、立法權(quán)限、立法技術(shù)等立法學(xué)基本問題的研究,雖然這些基本問題是立法理論研究不可或缺的因素,對立法質(zhì)量的提高有很大的意義,但是單純研究這些問題,已經(jīng)不能解決和協(xié)調(diào)不同時(shí)期、不同部門法律法規(guī)之間的矛盾和沖突。法律法規(guī)質(zhì)量好不好,歸根結(jié)底是看法律法規(guī)的適用情況,看法律法規(guī)是否能夠經(jīng)受實(shí)踐的考驗(yàn),達(dá)到預(yù)期的效果。這就要求立法機(jī)關(guān)在法規(guī)適用階段進(jìn)一步關(guān)注其實(shí)施情況,做到心中有數(shù),在必要時(shí)予以修改,以適應(yīng)經(jīng)濟(jì)、社會(huì)發(fā)展的需要。因此開展立法后評估工作勢在必行。 而構(gòu)建立法后評估指標(biāo)體系是開展立法后評估的核心義項(xiàng)。在立法后評估中,評估指標(biāo)起到風(fēng)向標(biāo)的作用。指標(biāo)體系科學(xué)合理,可以正確反映立法的效果和效益,引導(dǎo)立法工作的良性發(fā)展;指標(biāo)體系設(shè)計(jì)不盡合理,則有可能誤導(dǎo)對制度與規(guī)范的選擇。構(gòu)建評估指標(biāo)體系是立法后評估活動(dòng)中非常重要的工作。評估指標(biāo)體系能夠?yàn)榱⒎ê笤u估提供科學(xué)、客觀的尺度和標(biāo)準(zhǔn),是評估取得實(shí)效的有力保障,并可對日常立法工作起到引導(dǎo)作用。因此,加強(qiáng)立法后評估指標(biāo)體系的研究具有重大的意義和價(jià)值。 立法后評估制度在國外早已成為定制。而國內(nèi)對立法后評估制度的研究才剛剛起步,雖然實(shí)踐中已經(jīng)有不少的地方開展了立法后評估,但是在理論界,學(xué)者們的研究主要集中在對立法后評估概念的界定、分析立法后評估制度產(chǎn)生的原因及意義、立法后評估的方式等問題的研究。對具體的評估指標(biāo)體系進(jìn)行深入研究的則更是少數(shù)。因此有必要進(jìn)一步加強(qiáng)立法后評估指標(biāo)體系的研究,加快評估指標(biāo)體系的構(gòu)建,以進(jìn)一步完善我國的立法后評估制度。 本文通過對各個(gè)國家立法后評估標(biāo)準(zhǔn)的考察,總結(jié)出了適合我國的立法后評估模式。主要從法律法規(guī)本身的質(zhì)量、法律法規(guī)的實(shí)施情況以及法律法規(guī)實(shí)施的效果三方面來設(shè)計(jì)指標(biāo),進(jìn)行我國立法后評估指標(biāo)體系的構(gòu)建。指標(biāo)設(shè)計(jì)出來以后還要對各個(gè)指標(biāo)進(jìn)行量化和綜合統(tǒng)一,以便于對法律法規(guī)進(jìn)行全面的分析,進(jìn)而保證立法機(jī)關(guān)正確高效地對法律法規(guī)進(jìn)行立、改、廢,使立法與時(shí)俱進(jìn),切實(shí)可行。
[Abstract]:The traditional legislative theory attaches great importance to the study of the basic problems of legislation, such as legislative process, legislative competence, legislative technology and so on. Although these basic problems are indispensable factors in the study of legislative theory, they are of great significance to the improvement of legislative quality. But simply studying these problems can not solve and coordinate the contradictions and conflicts between laws and regulations of different departments in different periods. Whether the quality of laws and regulations is good in the final analysis depends on the application of laws and regulations and whether laws and regulations can withstand the test of practice to achieve the desired results. This requires the legislature to pay further attention to its implementation in the stage of the application of laws and regulations, and make sure that it can be modified if necessary to meet the needs of economic and social development. Therefore, it is imperative to carry out the post-legislative evaluation. The construction of the legislative post-evaluation index system is the core meaning of the post-legislative evaluation. In the post-legislative evaluation, the evaluation index acts as a wind vane. If the index system is scientific and reasonable, it can correctly reflect the effect and benefit of legislation and guide the benign development of legislative work. If the design of index system is not reasonable, it may mislead the choice of system and norm. It is very important to construct the evaluation index system in the post-legislative evaluation. The evaluation index system can provide scientific, objective scale and standard for the post-legislative evaluation. It is a powerful guarantee for the effectiveness of the evaluation and can guide the daily legislative work. Therefore, it is of great significance and value to strengthen the research on the index system of post-legislative evaluation. The post-legislative evaluation system has long been customized abroad. But the domestic research on the post-legislative evaluation system has just started. Although there have been many places to carry out the post-legislative evaluation in practice, but in the theoretical circle, scholars mainly focus on the definition of the concept of post-legislative evaluation. Analysis of the causes and significance of the post-legislative evaluation system, the way of post-legislative evaluation and other issues. The specific evaluation index system is a small number of in-depth research. Therefore, it is necessary to further strengthen the research of the post-legislative evaluation index system and accelerate the construction of the evaluation index system in order to further improve our country's post-legislative evaluation system. Based on the investigation of the standards of post-legislative evaluation in various countries, this paper summarizes the model of post-legislative evaluation suitable for our country. The index is designed from three aspects: the quality of the laws and regulations themselves, the implementation of laws and regulations and the effect of the implementation of laws and regulations, and the construction of the evaluation index system after legislation is carried out in our country. After the design of the indicators, it is necessary to quantify and unify the various indicators in order to facilitate the comprehensive analysis of laws and regulations, thereby ensuring that the legislature can correctly and efficiently set up, reform and scrap laws and regulations, so that legislation can keep pace with the times.
