【摘要】： 在我國社會主義發(fā)展進程中,加強地方立法工作,提高地方立法質(zhì)量已經(jīng)成為我國立法工作的當務之急。近年來,隨著立法行為在社會的需求中的增大,雖然制定了大量的地方性法規(guī),取得了很大的成績,但地方立法質(zhì)量普遍較低,從中暴露出了許多問題。為提高地方立法質(zhì)量,我們要找出解決問題的方法并加以完善。只有完善地方立法質(zhì)量,才能推進我國社會主義法律體系的建設。 本文首先介紹了我國地方立法質(zhì)量的基本理論;接著對西方國家地方立法權限劃分標準和地方立法程序的情況進行了比較借鑒;然后從地方立法質(zhì)量存在的問題和影響的因素這兩方面分析我國目前地方立法質(zhì)量的現(xiàn)狀;最后提出了對提高我國地方立法質(zhì)量的幾點建議并加以完善。
[Abstract]:In the process of socialist development in China, strengthening local legislation and improving the quality of local legislation have become the urgent task of our country's legislative work. In recent years, with the increase of the social demand, a large number of local laws and regulations have been made and great achievements have been made, but the quality of local legislation is generally low. In order to improve the quality of local legislation, we should find ways to solve the problem and improve it. Only by improving the quality of local legislation can we promote the construction of the socialist legal system in our country.
This article first introduces the basic theory of the quality of local legislation in China, and then makes a comparison of the criteria for the division of local legislative authority and the local legislative procedure in western countries, and then analyzes the present situation of the quality of the local legislation in China from the two aspects of the existing problems of the quality of the local legislation and the factors affecting it. Several suggestions for improving the quality of local legislation in China are put forward.
