【摘要】： 張佛泉是中國近代自由主義及憲政理論上有重要影響的歷史人物之一,他針對國民政府時期憲政發(fā)展的方方面面提出了自己獨特的觀點與看法,盡管沒有從實踐中得到驗證,但是他的憲政思想較大地豐富了近代中國憲政理論。本文將對張佛泉的憲政理論結合時局進行初步考察。 除緒論和余論外,本文共分三章。緒論部分對張佛泉憲政思想研究的源起、價值、研究現(xiàn)狀、該項研究存在的問題和本文擬待解決的問題等方面進行了簡單的介紹,同時對一些概念進行了簡單的界定。第一章分析張佛泉憲政思想形成的時代背景、知識背景。第二章探討張佛泉憲政思想的主要內(nèi)容,包括對訓政的批評、對憲政的設計,和對實施憲政的條件的思考等。第三章通過與胡適、梁漱溟的憲政思想對比,分析張佛泉憲政思想的特征。余論部分則是對張佛泉憲政思想的理論價值進行客觀的評價,并從中指出其對當前憲政改革中有益的借鑒之處。 總之,本文對張佛泉憲政思想的研究,力求采取客觀的態(tài)度,既不夸大亦不貶低,著力從中總結出其理論價值及現(xiàn)實啟示。
[Abstract]:Zhang Foquan is one of the most important historical figures in modern Chinese liberalism and constitutional theory. He put forward his own unique views and opinions on all aspects of constitutional development in the period of the National Government, although he has not been verified in practice. But his constitutional thought greatly enriched the modern Chinese constitutional theory. This article will carry on the preliminary investigation to Zhang Foquan's constitutionalism theory unifies the situation. In addition to the introduction and the conclusion, this paper is divided into three chapters. In the introduction part, the origin, value, research status, the existing problems of the research and the problems to be solved in this paper are briefly introduced. At the same time, some concepts are simply defined. The first chapter analyzes the background and knowledge background of the formation of Zhang Foquan's constitutional thought. The second chapter discusses the main contents of Zhang Foquan's constitutional thought, including the criticism of the political training, the design of the constitutional government, and the consideration of the conditions for the implementation of the constitutionalism. The third chapter analyzes the characteristics of Zhang Foquan's constitutional thought by comparing it with Hu Shi and Liang Shuming's constitutional thought. The remaining part is an objective evaluation of the theoretical value of Zhang Foquan's constitutional thought, and points out its beneficial reference to the current constitutional reform. In a word, this paper tries to take an objective attitude towards the study of Zhang Foquan's constitutional thought, neither exaggerates nor belittles, and tries to sum up its theoretical value and practical enlightenment.
