學(xué)術(shù)精神緣何被異化——基于學(xué)術(shù)權(quán)力和學(xué)術(shù)權(quán)利不當(dāng)行使的法理解析

【摘要】:學(xué)術(shù)精神是學(xué)術(shù)研究的靈魂和導(dǎo)向,是學(xué)者獨(dú)立、自由、求真、創(chuàng)新等學(xué)術(shù)品格的表達(dá)。學(xué)術(shù)精神的彰顯既需要學(xué)者正當(dāng)?shù)匦惺箤W(xué)術(shù)權(quán)利,包括秉持求真務(wù)實(shí)的研究態(tài)度、恪守學(xué)術(shù)道德和學(xué)術(shù)規(guī)范、規(guī)避學(xué)術(shù)失范和學(xué)術(shù)不端等。同時(shí),也有賴于國家或管理者在學(xué)術(shù)資源、學(xué)術(shù)政策與法律等外部條件上予以合理設(shè)計(jì)和有力支撐。外部條件中的權(quán)力因素與學(xué)術(shù)資源有限性的疊加,使得學(xué)術(shù)權(quán)利的行使不僅具有依附性,而且還充滿競(jìng)爭(zhēng)性。由于學(xué)術(shù)自律和他律的不足和失控,當(dāng)下的學(xué)術(shù)研究有了浮躁、功利、失范、不端等學(xué)術(shù)精神異化的心理和行為表征,并有愈演愈烈之勢(shì)。從法理的角度解析,管理者學(xué)術(shù)權(quán)力行政化、利益化是學(xué)術(shù)精神異化的外在趨導(dǎo)因素;學(xué)者學(xué)術(shù)權(quán)利功利化、親權(quán)力化是學(xué)術(shù)精神異化的內(nèi)在驅(qū)動(dòng)因素。因此,基于學(xué)術(shù)法治的內(nèi)在要求,應(yīng)當(dāng)對(duì)學(xué)術(shù)權(quán)力和學(xué)術(shù)權(quán)利的行使加以規(guī)制。
[Abstract]:Academic spirit is the soul and direction of academic research, and the expression of academic character such as independence, freedom, truth and innovation. The manifestation of academic spirit requires scholars to exercise their academic rights properly, including adhering to the attitude of seeking truth and practical research, abiding by academic morality and academic norms, avoiding academic misconduct and academic misconduct, and so on. At the same time, it also depends on the reasonable design and strong support of the country or the administrator in the external conditions such as academic resources, academic policies and laws. The superposition of power factors in external conditions and limited academic resources makes the exercise of academic rights not only dependent but also competitive. Due to the deficiency and uncontrollable of academic self-discipline and heteronomy, the present academic research has been characterized by impetuous, utilitarian, abnormal and improper academic spirit alienation, and has the tendency of becoming more and more intense. From the point of view of legal theory, the author points out that the administration of academic power and interest are the external guiding factors of alienation of academic spirit, while the utilitarianism and pro-power of academic rights are the internal driving factors of alienation of academic spirit. Therefore, based on the inherent requirements of academic rule of law, academic power and the exercise of academic rights should be regulated.
