【摘要】：建立金朝的女真族在與中原文化接觸的過程中,不斷學習、吸收中原文化,在法律制度上也不例外。杖刑、笞刑是中國古代較為常見的刑罰種類。與其他朝代不同的是,金朝的杖、笞二刑名稱雖異,實則是同一種刑罰,體現(xiàn)了刑罰從輕的儒家"仁"的思想;金朝杖刑的判定實施則體現(xiàn)了儒家"以民為本"的治國主張和"貴賤有序"等倫理觀念;此外,金朝杖刑的精神懲戒作用要遠重于肉體之罰,反映了儒家注重教化的廉恥文化。這些觀念都非女真族入主中原前所有,是金朝法律吸收儒家思想理念的結(jié)果,反映了金朝對中原文化的認同。
[Abstract]:In the process of contacting with the Central Plains culture, the Nu Zhen nationality of the Jin Dynasty was constantly learning and absorbing the Central Plains culture, and the legal system was no exception. Wand, flogging is a common type of punishment in ancient China. Different from other dynasties, although the name of the second punishment of the Jin Dynasty is different, it is actually the same punishment, which embodies the thought of "benevolence" of the Confucianism. On the other hand, the judgment and implementation of the wand punishment in the Jin Dynasty embodies the Confucian ethics of "taking the people as the foundation" and "the order of the noble and the humble". In addition, the punishment of the staff of the Jin Dynasty is far more important than the punishment of the body, which reflects the Confucian culture of honesty and shame, which attaches importance to the cultivation of the people. All these ideas were not owned by the Feminis before they took over the Central Plains. They were the result of the legal absorption of Confucian ideas by the Jin Dynasty, which reflected the Jin Dynasty's recognition of the Central Plains culture.
