【摘要】：對英國誹謗界定作了歷史梳理,并結(jié)合其法律規(guī)制的歷史演進(jìn)梗概對20世紀(jì)以來的誹謗訴訟及其法律規(guī)制的一些主要情況作了簡要闡述,包括20世紀(jì)英國誹謗法中的主要變革,突出的誹謗訴訟和網(wǎng)絡(luò)誹謗訴訟,以及在西方國家頗具爭議的"誹謗旅游現(xiàn)象"等,以期為我國關(guān)于誹謗的司法實(shí)踐與對策研究提供借鑒。
[Abstract]:In this paper, the definition of libel in Britain is reviewed, and the main situations of libel litigation and its legal regulation since the 20th century are briefly expounded, including the major changes in the British libel law in the 20th century. The prominent libel litigation and network libel lawsuit, as well as the controversial "libel tourism phenomenon" in western countries, are expected to provide reference for the study of judicial practice and countermeasures of defamation in China.
