【摘要】： 本文從新近發(fā)掘的契約入手,對(duì)清代中后期寧波地區(qū)民間的不動(dòng)產(chǎn)交易習(xí)慣進(jìn)行了初步考察。此批契約自清道光四年(1824年)至光緒三十一年(1905年),以田、地契為主,兼有少量的地基、房、墻、山、井等契。通過(guò)對(duì)清代中后期寧波地區(qū)地理、經(jīng)濟(jì)等情況進(jìn)行的梳理,筆者發(fā)現(xiàn)寧波地區(qū)的工商業(yè)、手工業(yè)在這一時(shí)期飛速發(fā)展,利潤(rùn)值遠(yuǎn)高于傳統(tǒng)農(nóng)業(yè),從而導(dǎo)致從事商業(yè)的人口日益增多;同時(shí),人多地少、稅目繁多和某些奢靡的風(fēng)氣,迫使一些百姓不得不典賣田產(chǎn)。以上兩種因素的結(jié)合,使清代中后期寧波地區(qū)的產(chǎn)權(quán)交易日益頻繁。筆者從不動(dòng)產(chǎn)交易契約的形式和內(nèi)容出發(fā),初步總結(jié)了清代中后期寧波地區(qū)不動(dòng)產(chǎn)交易習(xí)慣,并試圖尋找其背后的根源所在。
[Abstract]:Starting from the newly discovered contracts, this paper makes a preliminary investigation on the folk real estate trading habits in Ningbo in the middle and late Qing Dynasty. These leases range from four years (1824) to thirty-one (1905) in Guang Xu, mainly in farmland and land deeds, with a small number of foundations, houses, walls, mountains, wells, etc. By combing the geography and economy of Ningbo in the middle and late Qing Dynasty, the author found that the industrial and commercial and handicraft industry in Ningbo developed rapidly in this period, and the profit value was much higher than that in traditional agriculture. This led to a growing number of people engaged in business; at the same time, the large number of people, land, taxes, and some extravagant customs forced some people to sell land and property. The combination of the above two factors made the property right transactions in Ningbo area more frequent in the middle and late Qing Dynasty. Starting from the form and content of the real estate transaction contract, the author summarizes the real estate transaction habits in Ningbo in the middle and late Qing Dynasty, and tries to find the root behind it.
