【摘要】： 隨著網(wǎng)絡(luò)技術(shù)的發(fā)展,網(wǎng)絡(luò)公共輿論也隨之出現(xiàn),并對(duì)政治的決策和社會(huì)公共事務(wù)的運(yùn)行產(chǎn)生很大的影響。網(wǎng)絡(luò)公共輿論同時(shí)也是民意的載體,是反映民意表達(dá)民意的平臺(tái),而且給予了網(wǎng)民充分的話語(yǔ)權(quán)。在維護(hù)公民權(quán)利、限制公權(quán)力培養(yǎng)公民法治精神方面網(wǎng)絡(luò)公共輿論也起到了促進(jìn)作用,同時(shí)也促進(jìn)了我國(guó)的法治進(jìn)程。但是現(xiàn)在我國(guó)網(wǎng)絡(luò)公共輿論并不是很規(guī)范,其中存在著很多虛假言論、不理性言論、網(wǎng)絡(luò)侵權(quán)現(xiàn)象,其根本原因就是網(wǎng)民的公民性素質(zhì)有待提高。要解決類似問(wèn)題就要從制度上和機(jī)制上來(lái)規(guī)制網(wǎng)絡(luò)公共輿論。對(duì)網(wǎng)絡(luò)公共輿論不能采用放任的態(tài)度,要內(nèi)外結(jié)合的規(guī)制網(wǎng)絡(luò)公共輿論,從內(nèi)部促使網(wǎng)民自律、外部制定網(wǎng)絡(luò)法規(guī),使網(wǎng)絡(luò)公共輿論的理論功能得到發(fā)揮,這樣才能推進(jìn)我國(guó)的法治進(jìn)程。
[Abstract]:With the development of network technology, network public opinion also appears, and has a great influence on the political decision-making and the operation of social public affairs. Network public opinion is also the carrier of public opinion, which is the platform to reflect public opinion, and gives Internet users full right to speak. The network public opinion has also played a promoting role in safeguarding citizens' rights and restricting public power to cultivate citizens' spirit of ruling by law, at the same time, it has also promoted the process of ruling by law in our country. But now the public opinion of network in our country is not very standard, among which there are many false speech, irrational speech, network tort phenomenon, the fundamental reason is that the citizen quality of the netizen needs to be improved. To solve similar problems, we should regulate network public opinion from the system and mechanism. To the network public opinion cannot adopt the laissez-faire attitude, must combine the internal and external regulation network public opinion, from the inside urges the netizen self-discipline, outside formulates the network laws and regulations, causes the network public opinion theory function to be brought into play. Only in this way can we advance the process of rule of law in our country.
