【摘要】：隨著經(jīng)濟(jì)蓬勃發(fā)展,世界各國開放與交流不斷加強(qiáng),越南社會也呈現(xiàn)巨大的發(fā)展步伐。世界多種文化的融入使越南傳統(tǒng)道德基礎(chǔ)受到很大影響,在經(jīng)濟(jì)市場背景下面臨著被“遺忘”的狀況。與此同時(shí),在金錢的誘惑下,為了牟利,很多人不顧一切,甚至犯法。這已給越南社會敲響了道德與法律意識下滑的警鐘,作者希望本研究(胡志明關(guān)于法律和道德關(guān)系的國家管理思想研究)可為此提出具有研究價(jià)值的意見和建議,將胡志明思想更好地運(yùn)用在國家建設(shè)事業(yè)。 雖然已有學(xué)者研究胡志明道德、法律思想,但關(guān)于其道德與法律關(guān)系思想在國家管理中的作用的研究卻屈指可數(shù)。因?yàn)楹久魉枷胍话憬?jīng)過某些真實(shí)的故事,或由他親身經(jīng)歷過的事情,或體現(xiàn)在他與干部及人民的講話中。幾乎沒有任何專門文件提到法律或法律及道德之間的關(guān)系。因此,收集與研究參考資料并非易事。 本研究目的在于考察胡志明關(guān)于道德、法律及道德與法律關(guān)系的思想。在此基礎(chǔ)上提出法律、道德以及兩者在越南法權(quán)國家建設(shè)背景下的結(jié)合的重要性。同時(shí)作者也提出若干措施以更有效地將其運(yùn)用到國家管理領(lǐng)域。
[Abstract]:With the vigorous development of economy and the strengthening of opening and communication, Vietnamese society has made great progress. The integration of various cultures in the world has greatly affected the traditional moral basis of Vietnam and is facing the situation of being forgotten under the background of economic market. At the same time, in the temptation of money, in order to profit, many people regardless of everything, or even illegal. This has sounded a wake-up call for the decline of moral and legal consciousness in Vietnamese society, and the author hopes that this study (Hu Zhiming's study on the national management ideology on the relationship between law and morality) can provide valuable opinions and suggestions for this purpose. Hu Zhiming will be better applied to the cause of national construction. Although some scholars have studied Hu Zhiming's moral and legal thoughts, there are only a few studies on the role of his moral and legal relations in the management of the state. This is because Hu Zhiming's thoughts generally go through some true story, or something he has experienced personally, or embodied in his speeches with cadres and the people. Few special documents mention the law or the relationship between law and morality. Therefore, the collection and research of reference materials is not easy. The purpose of this study is to investigate Hu Zhiming's thoughts on morality, law and the relationship between morality and law. On this basis, this paper points out the importance of law, morality and the combination of the two in the context of the construction of Vietnam's legal power. At the same time, the author also puts forward some measures to apply it more effectively in the field of state management.
