從山東政法學(xué)院的辦學(xué)歷程看新中國法律教育的經(jīng)驗(yàn)教訓(xùn)及其對策

【摘要】: 摘要內(nèi)容:百年大計(jì),教育為本。一個國家或一個地區(qū)法律教育的發(fā)展程度,與這個國家或地區(qū)法制的完備程度、法律的發(fā)達(dá)程度、人們對法律職業(yè)的態(tài)度有著密切的關(guān)系,在一定意義上已經(jīng)成為衡量社會文明進(jìn)程和法治建設(shè)進(jìn)程的重要標(biāo)志。法制的現(xiàn)代化需要法律人才的現(xiàn)代化;法律人才的現(xiàn)代化需要法律教育的現(xiàn)代化。山東政法學(xué)院的發(fā)展歷程,可以說是新中國成立之后中國法律教育和法制進(jìn)程的一個縮影,不僅可以從一個小的角度反映出新中國法律教育的發(fā)展?fàn)顩r,而且在一定程度上也折射出了新中國的法制發(fā)展進(jìn)程。從山東政法學(xué)院的建立、發(fā)展過程中,我們可以總結(jié)出很多法律教育經(jīng)驗(yàn),為中國現(xiàn)代法制教育提供許多有益的借鑒,提出若干發(fā)人深省的思考。 本文首先依據(jù)山東政法學(xué)院發(fā)展的階段性特點(diǎn)回顧了其發(fā)展歷程,主要分為1955-1961年的“山東政法學(xué)院”、1979-1982年以短期培訓(xùn)為主的“山東政法學(xué)院”、1983-1988年開始學(xué)歷教育的“山東政法學(xué)院”、1989-1996年開展?粕究平逃摹吧綎|政法學(xué)院”、1997-2005年提出改建設(shè)想并為之奮斗的“山東政法學(xué)院”、2005年至今的山東政法學(xué)院等6個階段。 其次,由于法律教育制度作為政法干部隊(duì)伍的培養(yǎng)選拔制度,既是中國高等教育制度的組成部分,又是我國司法制度的重要內(nèi)容;法律教育工作既是一項(xiàng)教育工作,更是政法工作的重要組成部分,因此,山東政法學(xué)院近半個世紀(jì)的高等法律教育的發(fā)展歷程,為我國法律教育事業(yè)的改革與發(fā)展積累了豐富的經(jīng)驗(yàn),主要包括法律教育與辦學(xué)必須大力加強(qiáng)領(lǐng)導(dǎo)班子建設(shè),適時調(diào)整發(fā)展目標(biāo),走特色發(fā)展之路;法律教育與辦學(xué)必須走多層次、多形式、多渠道的辦學(xué)之路;法律教育與辦學(xué)必須注重理論與實(shí)踐相結(jié)合;法律教育與辦學(xué)必須注重交流與合作;法律教育與辦學(xué)必須加強(qiáng)思想政治工作;法律教育必須注重科研工作等6個方面。 法律教育是培養(yǎng)法律人才的重要工作,而法律人才是建設(shè)法治國家的第一資源。從這個意義上講,今日中國的法律教育將決定明日中國的法治建設(shè)。所以,本文最后從山東政法學(xué)院的法律教育與辦學(xué)實(shí)踐中引申出若干對于我國現(xiàn)階段法律教育與辦學(xué)的思考,如應(yīng)該注重內(nèi)涵發(fā)展,不能盲目跟進(jìn)、應(yīng)該注重人的全面發(fā)展、應(yīng)該注重改革與創(chuàng)新、應(yīng)該依據(jù)自身的條件和特色適度發(fā)展、在與實(shí)踐相結(jié)合方面還應(yīng)加大力度等等,或許有助于認(rèn)識新時期法律教育面臨的歷史背景、肩負(fù)的歷史使命,有助于明確法律教育的發(fā)展方向和奮斗目標(biāo),有助于理解法律教育的培養(yǎng)標(biāo)準(zhǔn),培養(yǎng)規(guī)格和培養(yǎng)要求,有助于分析法律教育存在的突出問題,有助于完善和健全法律人才宏觀培養(yǎng)模式,并進(jìn)而形成法律職業(yè)共同體和法律人才培養(yǎng)共同體之間的良性互動。
[Abstract]:Absrtact: education is the foundation of a hundred-year plan. The degree of development of legal education in a country or region is closely related to the degree of completeness of the legal system in this country or region, the degree of legal development, and the attitude of people towards the legal profession. In a certain sense, it has become an important symbol to measure the progress of social civilization and the construction of the rule of law. The modernization of legal system requires the modernization of legal talents, and the modernization of legal talents requires the modernization of legal education. The course of development of the Shandong Institute of political Science and Law can be said to be a microcosm of China's legal education and legal process after the founding of New China. It can not only reflect the development of legal education in New China from a small angle. Moreover, to some extent, it also reflects the development process of the new China's legal system. In the course of the establishment and development of Shandong Institute of political Science and Law, we can sum up a lot of experience of legal education, provide many useful references for China's modern legal education, and put forward some thought-provoking thoughts. This paper first reviews the development process of Shandong Institute of political Science and Law according to the stage characteristics of its development. "Shandong Institute of political Science and Law" from 1955-1961 to "Shandong Institute of political Science and Law" from 1979-1982 to "Shandong Institute of political Science and Law" from 1983-1988 and "Shandong Institute of political Science and Law" from 1983-1988. "Shandong Institute of political Science and Law" from 1989 to 1996 From 1997 to 2005, Shandong Institute of political Science and Law (Shandong Institute of political Science and Law) and Shandong Institute of political Science and Law (Shandong Institute of political Science and Law) were put forward and worked for. Secondly, as the training and selection system of the contingent of political and legal cadres, the legal education system is not only an integral part of China's higher education system, but also an important part of our judicial system. Therefore, the course of the development of higher legal education in Shandong Institute of political Science and Law in the past half century has accumulated rich experience for the reform and development of the cause of legal education in our country. It mainly includes legal education and running a school must strengthen the construction of leading group, adjust the development goal in time, and take the road of characteristic development, the legal education and running a school must take a multi-level, multi-form, multi-channel way of running a school. Legal education and school running must pay attention to the combination of theory and practice, legal education and school running must pay attention to communication and cooperation, legal education and school running must strengthen ideological and political work, and legal education must pay attention to scientific research work. Legal education is an important work to train legal talents, and legal talents are the first resource to build a country ruled by law. In this sense, legal education in China today will determine the construction of the rule of law in China tomorrow. Therefore, from the practice of law education and running school of Shandong University of political Science and Law, this paper draws some thoughts on the present stage of legal education and running of our country, such as paying attention to the development of connotation, not blindly following up, and paying attention to the all-round development of human beings. We should pay attention to reform and innovation, develop appropriately according to our own conditions and characteristics, and strengthen our efforts in combining with practice, etc., which may help to understand the historical background and historical mission of legal education in the new period. It is helpful to clarify the development direction and goal of legal education, to understand the training standards, training specifications and requirements of legal education, and to analyze the outstanding problems in legal education. It is helpful to perfect and perfect the macro training mode of legal talents, and then form the positive interaction between the legal professional community and the legal talent training community.
