甘肅省高校法學(xué)教育的問題分析與對策研究

【摘要】:甘肅的現(xiàn)代法學(xué)教育肇始于清宣統(tǒng)元年(1909年)創(chuàng)辦的甘肅法政學(xué)堂,甘肅法學(xué)教育發(fā)展歷史和我國法學(xué)教育發(fā)展歷史一樣都經(jīng)歷了二十世紀(jì)從初創(chuàng)、遭受挫折、全面摧殘、恢復(fù)重建和改革發(fā)展的坎坷歷程。進(jìn)入二十一世紀(jì)以來,甘肅的法學(xué)教育迎來了嶄新的發(fā)展階段,無論從數(shù)量、規(guī)模還是教育模式等方面,都實現(xiàn)了跨越式的發(fā)展,甘肅的法學(xué)教育為甘肅和全國其他省份輸送了大量的法律人才,為社會主義法治事業(yè)和教育事業(yè)做出了很大貢獻(xiàn)。然而,作為一個相對落后的西部省份,甘肅的法學(xué)教育在學(xué)術(shù)能力、培養(yǎng)模式、人才引進(jìn)、教育資源、新興學(xué)科建設(shè)等方面與發(fā)達(dá)省份之間還存在非常大的差距。同時,也有著自身的缺點和繼續(xù)發(fā)展的局限性。譬如:法學(xué)教育與法律職業(yè)相脫節(jié)、法學(xué)院校學(xué)生知識結(jié)構(gòu)單一、法學(xué)院校和學(xué)生數(shù)量盲目擴(kuò)張而質(zhì)量不高等新問題。針對以上問題,筆者認(rèn)為,結(jié)合西北地區(qū)甘肅法學(xué)教育的特點,未來甘肅法學(xué)教育主要有兩個重點:第一個重點是對甘肅法學(xué)教育的現(xiàn)有資源進(jìn)行整合,進(jìn)行優(yōu)勢互補;同時加強我省特色學(xué)科即優(yōu)勢學(xué)科的建設(shè),大力加強新興學(xué)科建設(shè)并進(jìn)行多學(xué)科和邊緣學(xué)科的交叉學(xué)習(xí)與培養(yǎng)。第二個重點是結(jié)合甘肅省特殊的省情,創(chuàng)新培養(yǎng)模式,使甘肅的法學(xué)教育更加著眼于甘肅實際的法律職業(yè)環(huán)境。為此,本文的論述結(jié)合甘肅高校法學(xué)教育分三個部分,第一部分提出了甘肅高等院校法學(xué)教育的現(xiàn)狀和存在的問題;第二部分論述了甘肅高等法學(xué)教育存在問題的緣由;第三部分結(jié)合國際國內(nèi)法學(xué)教育的經(jīng)驗和本省的特殊情況提出了符合甘肅高等院校法學(xué)教育的實際對策。
[Abstract]:The modern law education in Gansu began in the first year of Qing Dynasty (1909). The history of the development of law education in Gansu Province and the history of the development of law education in our country have all experienced from the beginning of the twentieth century, suffered setbacks, and destroyed all aspects. The bumpy course of reconstruction and reform and development. Since the 21 century, the law education in Gansu has ushered in a new stage of development. In terms of quantity, scale and educational model, it has achieved a leapfrog development. The law education in Gansu has sent a large number of legal talents to Gansu and other provinces in China, and has made great contributions to the cause of socialist rule of law and education. However, as a relatively backward western province, there is still a big gap between Gansu law education and developed provinces in academic ability, training model, talent introduction, educational resources, construction of new disciplines and so on. At the same time, it also has its own shortcomings and the limitations of continued development. For example, the law education is out of step with the law profession, the knowledge structure of law college students is single, the number of law colleges and students is expanding blindly and the quality is not high. In view of the above problems, the author thinks that according to the characteristics of Gansu law education in northwest region, there are two main points in the future Gansu law education: the first is to integrate the existing resources of Gansu law education, and to complement each other with its advantages; At the same time, we should strengthen the construction of the characteristic discipline of our province, that is, the advantage discipline, and strengthen the construction of the new discipline and carry on the cross study and cultivation of the multi-discipline and the borderline discipline. The second emphasis is to combine the special situation of Gansu Province, innovate the training mode, make the law education of Gansu pay more attention to the actual legal professional environment of Gansu Province. For this reason, this thesis combines with the law education of Gansu universities and colleges is divided into three parts: the first part puts forward the present situation and existing problems of the law education in Gansu colleges and universities, the second part discusses the causes of the problems existing in the higher law education in Gansu. The third part puts forward some practical countermeasures according with the experience of international and domestic law education and the special situation of this province.
