【摘要】: 中國(guó)法律倫理思想的產(chǎn)生,有其特定的環(huán)境土壤和其特殊的發(fā)展規(guī)律,但作為世界法律思想史的一部分,中國(guó)法律倫理思想也包含著其普遍性規(guī)律即人類(lèi)對(duì)人道、善良、正義、平等、秩序等基本價(jià)值理念的追求。對(duì)這一規(guī)律的動(dòng)態(tài)把握,離不開(kāi)對(duì)特定時(shí)空下的封建法典的相對(duì)靜態(tài)分析。 《唐律疏議》是中國(guó)現(xiàn)存的第一部?jī)?nèi)容完整的古代法典,也是中華法系的代表作,在世界法制史上具有很高的聲譽(yù)和地位,可以說(shuō)是世界中世紀(jì)法典的杰作。《唐律疏議》的成功之處,不僅僅在于作為一部法典所應(yīng)有的內(nèi)容結(jié)構(gòu)上的嚴(yán)謹(jǐn)和立法技巧上的嫻熟,更在于它把法律與倫理有機(jī)地融合在一起,極大地促進(jìn)并維系了唐王朝的興盛。《唐律疏議》作為盛唐時(shí)期的產(chǎn)物,對(duì)于緩和階級(jí)矛盾,維系社會(huì)的穩(wěn)定,促進(jìn)當(dāng)時(shí)社會(huì)的進(jìn)步,起到了十分關(guān)鍵的作用。 《唐律疏議》同時(shí)也是中國(guó)古代律法倫理化發(fā)展的產(chǎn)物!短坡墒枳h》以儒家天道觀作為立論基礎(chǔ),以“性三品”的人性論作為倫理依據(jù),將儒家之禮完全融入到封建律法里面,使歷史上儒法分合的問(wèn)題有了一個(gè)圓滿的結(jié)局,也使得中華法系最終得以形成。 《唐律疏議》無(wú)論是立法上對(duì)仁本刑末、立法公正、法貴責(zé)上以及和諧的社會(huì)秩序的孜孜追求,還是在司法上對(duì)程序正義、人道司法以及慎獄恤刑制度的不懈努力,都是為了封建統(tǒng)治的長(zhǎng)治久安,這是其本質(zhì)所決定的。但就在其對(duì)法律基本價(jià)值的不斷努力追求過(guò)程中,恰恰動(dòng)態(tài)的反映了法律倫理自身發(fā)展的規(guī)律。所以,對(duì)于《唐律疏議》的研究,不應(yīng)僅僅停留在法律制度等外在形態(tài)層面之上,更應(yīng)該從其內(nèi)在的價(jià)值層面上去把握。通過(guò)探究《唐律疏議》所蘊(yùn)含的法律倫理思想,可從深層去把握中國(guó)傳統(tǒng)法律的價(jià)值內(nèi)涵,揭示法律倫理的本質(zhì)和發(fā)展的規(guī)律性。這有助于溝通現(xiàn)代法律的價(jià)值理念和中國(guó)傳統(tǒng)法律的價(jià)值理念,從而加速實(shí)現(xiàn)當(dāng)今所移植法律的本土化,進(jìn)而實(shí)現(xiàn)本土法律的創(chuàng)新,為構(gòu)建具有中國(guó)特色的社會(huì)主義法制體系提供有益的參考。
[Abstract]:The emergence of Chinese legal ethics thought has its special environment soil and its special development law, but as a part of the history of the world legal thought, the Chinese legal ethics thought also contains its universal law, that is, humanity, kindness and justice. Equality, order and other basic values of the pursuit. The dynamic grasp of this law can not be separated from the relative static analysis of the feudal code in specific time and space. The Tang Law is the first existing ancient code of law in China, which is also a representative of the Chinese legal system. It has a high reputation and status in the history of the world legal system. It can be said that it is a masterpiece of the medieval codes of the world. The success of the Tang Law is not only due to the rigour of the content and the skill of legislation, More importantly, it merges law and ethics together organically, greatly promoting and maintaining the prosperity of the Tang Dynasty. As a product of the prosperous Tang Dynasty, it can alleviate the class contradictions, maintain social stability, and promote the progress of the society at that time. Played a very important role. At the same time, it is also the product of the ethical development of ancient Chinese law. Based on the Confucian concept of Heaven and Taoism, and the theory of human nature of "three things of nature" as the ethical basis, the Confucian rites are fully integrated into the feudal law. The problem of the separation of Confucianism and law in history has a happy ending, and also makes the Chinese legal system finally form. Whether it is the diligent pursuit of justice in legislation, high responsibility in law and harmonious social order, or unremitting efforts in judicial work on procedural justice, humane justice and the system of careful penitentiary and compassionate punishment, it is not only the pursuit of justice in legislation, but also the relentless pursuit of justice in law, and harmonious social order in law. For the long-term stability of feudal rule, this is its essence. However, in the process of pursuing the basic value of law, it reflects the law of the development of legal ethics. Therefore, the study of Tang Law should not only stay on the level of external form such as legal system, but also should be grasped from its intrinsic value level. By exploring the legal ethics thought contained in Tang Law, we can grasp the value connotation of Chinese traditional law and reveal the essence of legal ethics and the law of development. This helps to link the value concept of modern law with the value idea of Chinese traditional law, so as to accelerate the localization of the law transplanted today, and then realize the innovation of local law. For the construction of the socialist legal system with Chinese characteristics to provide a useful reference.
