【摘要】：自古以來,中華民族就是一個多民族國家,各民族在歷史長河中,共同勞動繁衍生息在祖國的大地上,創(chuàng)造了燦爛的中華文化和文明。西北少數(shù)民族對締造偉大祖國做出了卓越的貢獻(xiàn),與此同時,也形成了自身獨(dú)具特色、多姿多彩的民族文化。在民族文化中,法律文化是其重要的組成部分,法律文化也有自身相對獨(dú)特的文化形式、載體和實(shí)現(xiàn)方法。西北各少數(shù)民族法律文化的生成不僅是其所屬時代階級性的要求,也與一個民族的心理、生產(chǎn)方式、宗教信仰密切相關(guān)。本文以馬克思列寧主義、毛澤東思想、鄧小平理論為指引,結(jié)合黨的各民族平等、團(tuán)結(jié)和共同繁榮的原則,研究我國西北少數(shù)民族地區(qū)法律文化建設(shè)。 文章主體分為五部分：緒論,介紹了本文研究的意義、國內(nèi)外研究現(xiàn)狀和文章的研究方法；第一章,基礎(chǔ)理論問題研究,介紹了相關(guān)基本概念、西北少數(shù)民族地區(qū)法律文化的特點(diǎn),對西北少數(shù)民族地區(qū)法律文化建設(shè)的理論認(rèn)識；第二章,西北少數(shù)民族地區(qū)法律文化的發(fā)展現(xiàn)狀及存在的主要問題,主要從西北少數(shù)民族地區(qū)法律文化的發(fā)展現(xiàn)狀及成功經(jīng)驗,西北少數(shù)民族地區(qū)法律文化及存在的主要問題及原因分析兩方面展開；第三章,西北少數(shù)民族地區(qū)法律文化建設(shè)的國際視野,分別介紹了英美法系、大陸法系、伊斯蘭法系法律文化的形成及對我國的借鑒；第四章,構(gòu)建西北少數(shù)民族地區(qū)法律文化的基本思路,分別從遵循憲法、維護(hù)法制統(tǒng)一,明確西北少數(shù)民族地區(qū)法律文化建設(shè)的目標(biāo),健全相關(guān)立法,突出地方立法和民族自治地方立法的作用,保障人權(quán)、進(jìn)一步加強(qiáng)和完善民族區(qū)域自治制度,加強(qiáng)民族地區(qū)現(xiàn)代化教育,促進(jìn)現(xiàn)代法律文化的生成和發(fā)展,強(qiáng)化政府在法律文化建設(shè)中的責(zé)任六個方面展開了論述。
[Abstract]:Since ancient times, the Chinese nation is a multi-ethnic country, all nationalities in the long river of history, the common labor and reproduction in the motherland on the earth, created a brilliant Chinese culture and civilization. Northwest ethnic minorities made outstanding contributions to the creation of the great motherland, at the same time, they formed their own unique and colorful national culture. In national culture, legal culture is an important part of it. Legal culture also has its own relatively unique cultural form, carrier and realization method. The formation of the legal culture of the ethnic minorities in Northwest China is not only the requirement of the class character of the times to which they belong, but also closely related to the psychology, production mode and religious belief of a nation. Under the guidance of Marxism-Leninism, Mao Zedong's thought and Deng Xiaoping's theory, combined with the principle of equality, unity and common prosperity of all nationalities of the Party, this paper studies the legal and cultural construction of ethnic minority areas in Northwest China. The main body of the article is divided into five parts: introduction, introducing the significance of this study, the domestic and foreign research status and research methods, the first chapter, basic theoretical research, introduced the relevant basic concepts, The characteristics of the legal culture in the northwest minority areas, the theoretical understanding of the legal culture construction in the northwest minority areas, the second chapter, the development status and the main problems of the legal culture in the northwest minority areas, Mainly from the northwest minority areas legal culture development status and successful experience, northwest minority areas legal culture and the main problems and reasons analysis two aspects; chapter three, The international field of view of legal culture construction in northwest minority areas, respectively, introduces the formation of legal culture of Anglo-American law system, civil law system and Islamic law system and its reference to our country. The basic ideas of constructing the legal culture in the northwest minority areas include following the constitution, maintaining the unity of the legal system, clarifying the goal of the legal culture construction in the northwest minority areas, and perfecting the relevant legislation. Stressing the role of local legislation and legislation in ethnic autonomous areas, safeguarding human rights, further strengthening and perfecting the system of regional national autonomy, strengthening modernization education in ethnic areas, and promoting the formation and development of modern legal culture, Strengthening the responsibility of the government in the construction of legal culture is discussed in six aspects.
