【摘要】：權(quán)利與義務(wù)都內(nèi)含個體性與社會性二重規(guī)定。歷史地看,彰顯權(quán)利的個體性之維,往往引向突出"我的權(quán)利";注重義務(wù)的社會性維度,則每每導(dǎo)向強(qiáng)化"你的義務(wù)"。揚(yáng)棄以上偏向,以視域的轉(zhuǎn)換和交融為前提,這里的轉(zhuǎn)換意味著從抽象形態(tài)的"我的權(quán)利"轉(zhuǎn)向現(xiàn)實(shí)關(guān)系中的"你的權(quán)利",從外在賦予(他律)意義上的"你的義務(wù)"轉(zhuǎn)向自覺和自愿承擔(dān)(自律)層面的"我的義務(wù)"。與之相關(guān)的視域融合,則表現(xiàn)為對權(quán)利二重規(guī)定與義務(wù)二重規(guī)定的雙重確認(rèn)。
[Abstract]:Both rights and obligations contain dual provisions of individuality and sociality. Historically, the individual dimension of rights is often led to highlight "my rights", and the social dimension of obligations is often guided to strengthen "your obligations". Sublation of the above bias, based on the transformation and blending of the horizon as the premise, The transformation here means from the abstract form of "my right" to the "your right" in the realistic relationship, from the "your obligation" in the sense of external giving to "my obligation" at the level of conscious and voluntary commitment (self-discipline). The fusion of vision is the double confirmation of double stipulation of right and obligation.
