保辜制度特性分析及現(xiàn)代影響

【摘要】: 保辜制度是中國古代刑事法律規(guī)范中一項旨在保護人身傷害案件中的受害人、追究加害人的法律責(zé)任,進而整合社會關(guān)系的制度。具體來說,當(dāng)人身傷害案件發(fā)生后,受害人傷情未定,如果受害人在法定的期限(即保辜期限,簡稱辜限)內(nèi)因該傷害死亡,對加害人以殺人罪論;如果受害人在法定的期限內(nèi)沒有死亡或因其他原因死亡,及在法定的期限之外死亡,則對加害人以傷害罪論處。此制度在中國古代社會存在發(fā)展了兩千余年。唐代是保辜制度的發(fā)展成熟時期,保辜制度得以定型化、系統(tǒng)化。保辜制度在宋、元、明、清繼續(xù)發(fā)展,并在立法及司法領(lǐng)域產(chǎn)生了一系列重要變化。保辜制度有其深刻的思想源淵,存在自身的規(guī)律性。 本篇論文共分為四章來全面系統(tǒng)的介紹保辜制度。第一章,為了使讀者對保辜制度有一個初步了解,首先敘明保辜制度的基本原理。繼而主要依從保辜制度的歷史發(fā)展脈絡(luò)依次介紹唐代以前的保辜制度、唐代以后的保辜制度。第二章,從法律的實體規(guī)定和具體的操作程序兩個方面介紹唐代的保辜制度。由于保辜制度在唐代發(fā)展最為完備,所以這部分的內(nèi)容以唐代為例詳細(xì)介紹保辜制度的具體內(nèi)容和操作程序。第三章,從保辜制度的合理之處與欠缺之處兩方面入手,對存在于中國歷史達幾千年之久的保辜制度作一全面的理性分析。其合理性主要表現(xiàn)在反它映了中國儒家的“無訟”思想;反映了古代社會統(tǒng)治階級的“慎刑”統(tǒng)治理念;體現(xiàn)了古代刑法對刑事因果關(guān)系理論認(rèn)識水平的不斷提高。其欠缺之處主要表現(xiàn)在它只注重行為結(jié)果而忽視行為人的主觀態(tài)度;包含了太多偶然因素;缺乏相關(guān)配套制度。第四章,著眼于古代保辜制度與現(xiàn)代社會的結(jié)合。主要從古代保辜制度的謙抑價值、人道價值、權(quán)利補救價值等方面展開。 保辜制度從創(chuàng)設(shè)起一直在中國歷朝歷代得到沿用和完善,不難看出,這項制度有著頑強的生命力,對于穩(wěn)定社會秩序起到了極大的積極作用。我國古代保辜制度雖與近、現(xiàn)代刑法學(xué)中的諸多理論存在著較大的沖突,導(dǎo)致了近、現(xiàn)代刑法對其進行了徹底的否棄,但保辜制度作為我國刑法史上一項重要的制度,其曾起的重要作用及所具有的沿革意義是不容忽視的。從總體上講,保辜制度是我國古代刑法中有積極意義的法律制度,作為一種優(yōu)秀文化遺產(chǎn),我們應(yīng)將其合理成分發(fā)揚光大。
[Abstract]:The system of protection against Koo is a system in ancient Chinese criminal law that aims to protect the victims of personal injury cases, investigate the legal responsibility of the perpetrators, and then integrate social relations. Specifically, when the personal injury case occurred, the victim injury situation is not determined, if the victim died as a result of the injury within the legal time limit (that is, the time limit for the protection of the victim, referred to as the Koo limit), the perpetrator will be subject to the crime of homicide; If the victim does not die within the statutory period or for any other cause, or dies outside the statutory period, the offender shall be punished as injurious. This system existed in ancient Chinese society for more than two thousand years. The Tang Dynasty was the mature period of the system, and the system was formalized and systematized. Baogu system continued to develop in Song, Yuan, Ming and Qing dynasties, and produced a series of important changes in the legislative and judicial fields. The system of protecting Koo has its profound ideological source and its own regularity. This paper is divided into four chapters to comprehensively and systematically introduce the system. In the first chapter, in order to give readers a preliminary understanding of the system, the basic principles of the system are described. Following the historical development of the system, the author introduces the system before the Tang Dynasty and the system after the Tang Dynasty. The second chapter introduces the system of protection and Koo-protection in Tang Dynasty from two aspects: the substantive provisions of law and the specific operation procedure. Since the system of protection of Koo was the most complete in the Tang Dynasty, this part of the content of the Tang Dynasty as an example to introduce the specific content of the system and the operation procedures. In the third chapter, the author makes a comprehensive and rational analysis of the system of protecting Koo, which existed for thousands of years in China, from the two aspects of the rationality and deficiency of the system. Its rationality is mainly reflected in the reflection of the "no lawsuit" thought of the Chinese Confucianists, the "careful punishment" ruling concept of the ruling class in ancient society, and the continuous improvement of the understanding level of the criminal causality theory in the ancient criminal law. The main deficiency is that it only pays attention to the result of behavior and neglects the subjective attitude of the actor; it contains too many accidental factors; and it lacks the relevant supporting system. Chapter four focuses on the combination of ancient protection and modern society. It mainly starts from the modest value, humanity value and right remedy value of the ancient system of protection and Koo. Since the establishment of the system, the system has been used and perfected throughout the dynasties in China. It is not difficult to see that this system has strong vitality and has played a great positive role in stabilizing the social order. Although there is a great conflict between the ancient system of protection and the recent and modern criminal jurisprudence, which leads to the complete rejection of the system by modern criminal law, it is an important system in the history of criminal law of our country. Its important role and historical significance can not be ignored. On the whole, the system of protecting Koo is a positive legal system in the ancient criminal law of our country. As an excellent cultural heritage, we should carry forward its reasonable elements.
