【摘要】： 中國社會(huì)轉(zhuǎn)型期的法治進(jìn)程中,民間法在近年來逐漸成為熱門話題。民間法在中國傳統(tǒng)社會(huì)中與國家法同樣起著舉足輕重的作用。《紅樓夢(mèng)》作為一部文學(xué)作品,從封建家族生活這一視角為人們展示出了民間法運(yùn)行的全景�！都t樓夢(mèng)》對(duì)婚姻家庭、宗法倫理關(guān)系、家法家規(guī)、婚喪祭祀禮俗、土地關(guān)系、析產(chǎn)繼承、典當(dāng)?shù)让袷玛P(guān)系都有明確的描寫或無意的表現(xiàn),充分展現(xiàn)出民間法的意義及其局限,為我們更準(zhǔn)確地理解民間法提供了重要基礎(chǔ),對(duì)于中國法治建設(shè)有積極意義。
[Abstract]:In the process of rule of law in the transitional period of Chinese society, folk law has gradually become a hot topic in recent years. Folk law plays an important role in the traditional Chinese society as well as the state law. As a literary work, Dream of Red Mansions shows people the panorama of the operation of folk law from the perspective of feudal family life. The relationship of patriarchal ethics, family rules, marriage, funeral, sacrifice, land, property analysis and inheritance, pawn and other civil relations are clearly described or unintentionally expressed, which fully shows the meaning and limitation of folk law. It provides an important basis for us to understand the folk law more accurately and has positive significance for the construction of China's rule of law.
