【摘要】：正【編者按】2003年杭州發(fā)生一起"強(qiáng)奸致死案",嫌疑人張輝、張高平二審分別被判死刑緩期2年執(zhí)行和15年有期徒刑,服刑已近10載。2013年3月26日上午,浙江省高級(jí)人民法院依法再審公開(kāi)宣判,撤銷原審判決,宣告張輝、張高平無(wú)罪。新華社記者報(bào)道了以下案情:2003年5月19日,杭州市公安局西湖區(qū)分局接報(bào),當(dāng)日上午10時(shí)許在杭州市西湖區(qū)留下鎮(zhèn)留泗路東穆塢村路段水溝內(nèi)發(fā)現(xiàn)一具女尸。經(jīng)公安機(jī)關(guān)偵查,認(rèn)定是當(dāng)晚開(kāi)車載貨、受托搭載被害人的安徽省歙縣張輝、張高平侄叔倆所為。2004年4月21日,杭州市中級(jí)人民法院以強(qiáng)奸罪分別判處張輝死刑、張高平無(wú)期徒刑。當(dāng)年10月19日,浙江省高級(jí)人民法院二審分別改判張輝死刑緩期2年執(zhí)行、張高平有期徒刑15年。2012年2月27日,浙江省高級(jí)人民法院對(duì)該案立案復(fù)查后,另行組成合議庭調(diào)閱案卷、查看審訊錄像,調(diào)查核實(shí)有關(guān)證據(jù)。當(dāng)年7月,復(fù)查合議庭專程前往該案被害人安徽老家進(jìn)行調(diào)查,8月前往新疆庫(kù)爾勒監(jiān)獄、石河子監(jiān)獄分別提審了張輝、張高平,并于2013
[Abstract]:A "rape death case" occurred in Hangzhou in 2003, in which suspects Zhang Hui and Zhang Gao Ping were sentenced to two years' suspension of death sentence and 15 years' imprisonment, respectively. The sentence has been served for nearly 10 years. On the morning of March 26, 2013, Zhejiang Provincial higher people's Court retried public judgment, annulled the original judgment, declared Zhang Hui and Zhang Gao Ping innocent. Xinhua News Agency reporter reported the following cases: on May 19, 2003, the Xihu District Branch of Hangzhou Public Security Bureau received a report that at 10:00 in Xihu District, Hangzhou City, a woman's body was found in the ditch of the road section of Liu Si Lu Dong Mu Wu Village in Xihu District, Hangzhou City. After investigation by the public security organs, it was determined that it was carried out that night by Zhang Hui of Shexian County, Anhui Province, and Uncle Zhang Gao Ping, who was entrusted with carrying the victim. On April 21, 2004, the Hangzhou Intermediate people's Court sentenced Zhang Hui to death for the crime of rape, respectively. Zhang Gao Ping was sentenced to life imprisonment. On 19 October of that year, the second instance of the Zhejiang Provincial higher people's Court revised Zhang Hui's death sentence to a two-year reprieve, and Zhang Gao Ping was sentenced to 15 years in prison. On February 27, 2012, the Zhejiang Provincial higher people's Court filed the case for review. A collegiate panel shall be formed separately to read the case file, to examine the video of the interrogation and to investigate and verify the relevant evidence. In July of that year, the collegiate panel of reexamination made a special trip to the victim's hometown in Anhui to investigate. In August, it went to the Xinjiang Korla prison, where Shihezi Prison arraigned Zhang Hui, Zhang Gao Ping, and in 2013.
