【摘要】： 英租威海衛(wèi)這位“鮮為人知性格內(nèi)向沉醉于書寫日記”的“大英帝國的灰姑娘”,在英國人32年的統(tǒng)治中留下了豐富而又紛繁駁雜的檔案材料。對這些資料的閱讀解析是研究英租威海衛(wèi)一切法律問題的根本依據(jù)。而如果我們能夠深入到這些檔案中,就會發(fā)現(xiàn)這位“姑娘”其實(shí)并不“灰”,她經(jīng)歷的豐富、性格的復(fù)雜足以牢牢的吸引住我們的目光,勾起我們研究的沖動(dòng)。筆者正是帶著這種沖動(dòng)研究了英租威海衛(wèi)的土地法律史。 土地作為威海衛(wèi)最根本的生產(chǎn)資料,所有社會關(guān)系的發(fā)生、法律制度的構(gòu)建以及法律秩序的形成都必然以它為中心而展開。所以,對英租威海衛(wèi)土地法律史的研究將是進(jìn)入英租威海衛(wèi)法律史的一把鑰匙。本文將從英租威海衛(wèi)土地法律制度的構(gòu)建以及土地法律秩序的形成來逐步解讀英租威海衛(wèi)土地法律史,并進(jìn)而引申出整個(gè)英租威海衛(wèi)的法律秩序是如何構(gòu)建和形成的,將“歷史意識通過法學(xué)表達(dá)出來”。為此目的,本文分為四個(gè)部分：前言、英租威海衛(wèi)土地法律制度研究、英租威海衛(wèi)土地法律秩序研究以及“土地”的延伸--英租威海衛(wèi)法律秩序研究。 前言部分簡單介紹了這一研究的歷史背景(中國歷史大背景和英租威海衛(wèi)歷史小背景的概括和比較)及其所引發(fā)的問題即英租威海衛(wèi)土地法律秩序是如何得以生成和運(yùn)作的,以及相關(guān)問題的研究材料、研究成果、研究現(xiàn)狀,并指出本文研究的獨(dú)特性及其目的； “土地法律制度”研究部分詳述了英國人在威海衛(wèi)的土地上究竟建立了一種什么樣的法律制度,該制度包含了哪些內(nèi)容,及其具有什么樣的特色,即“二元化”在英租威海衛(wèi)土地法律制度上的存在； “土地法律秩序”研究部分討論了英國人是如何依據(jù)法律制度進(jìn)而在威海衛(wèi)的土地上建立法律秩序的,以及其得以存在的真正原因,即“二元化”在英租威海衛(wèi)土地法律秩序中的存在及其存在的理由； “法律秩序”研究部分在前面的研究的基礎(chǔ)上論證了英租威海衛(wèi)法律秩序的形成其原因與土地法律秩序并無本質(zhì)的區(qū)別,它們有著共同的進(jìn)路,進(jìn)一步的強(qiáng)調(diào)了法律秩序形成的原因,并指出這種秩序給威海衛(wèi)帶來的現(xiàn)代化之光。 文中指出：歷史中法律秩序的構(gòu)建和形成的原因只不過是“當(dāng)時(shí)場合”的人們在承認(rèn)(合意)和沖突中基于利益的策略選擇罷了,而這種選擇在“彼時(shí)彼刻”竟然起到了一種變革傳統(tǒng)的功效。 同時(shí)本文還意欲強(qiáng)調(diào),對法律甚至是法治的研究不能將目光僅僅集中在文字修辭或“主義”之上,法律不僅是現(xiàn)實(shí)的,它更是歷史的,我們只有深入到歷史中,仔細(xì)觀察法律在歷史中的“生死存亡”,才能明白法律的真實(shí)意義,我們的研究也才能具備現(xiàn)實(shí)的價(jià)值。 本文也沒有什么哲學(xué)起點(diǎn)或方法論之類的東西,我對此并無了解,更不可能刻意的加以運(yùn)用。只不過是在閱讀這些檔案的過程中發(fā)現(xiàn)了這些“連續(xù)”和“斷裂”的存在以及其中的矛盾和沖突,并以此研究它們“存在”和發(fā)生的原因。 歷史不僅是“自在”的,她更是“反省”的。大歷史和小歷史、大格局和小格局之間的交替作用也許能使我們有機(jī)會通過對英租威海衛(wèi)法律史的研究看清整個(gè)法律秩序的變革是如何實(shí)現(xiàn)的,希望本文能有這樣的作用,是為作者之本意。
[Abstract]:The English rented Weihai Wei, "the Cinderella of the British Empire, which is intoxicated and intoxicated in writing," has left rich and complicated archives in the 32 years of British rule. Reading and parsing of these materials is the fundamental basis for studying all the legal questions of the British rented Weihai guards. In these files, it will be found that the "girl" is actually not "grey", her experience is rich, and the complexity of her character is enough to attract our eyes and to draw the impulse of our research. I am the author of this impulse to study the land law history of the British rented Weihai Wei.
Land as the most fundamental production data of Weihai Wei, the occurrence of all social relations, the construction of legal system and the form of legal order in Chengdu must be centered on it. Therefore, the study of the legal history of land rent in Weihai will be a key to the entry into the legal history of the British rented Weihai security law. This article will rent the legal system of the Weihai land. The construction of the degree and the formation of the legal order of land gradually read the history of the land law of Weihai in Britain, and then the legal order of the whole British rent of Weihai Wei is constructed and formed, and "the historical consciousness is expressed through law". This purpose is divided into four parts: the preface, the British rent of the Weihai land legal system Study on the study of the land law order in Weihai and the extension of "land" -- the study of the legal order of the British rent Weihai Wei.
The preface briefly introduces the historical background of this study (the big background of Chinese history and the summary and comparison of the small background of the British rented Weihai Wei) and the problems arising from how the land legal order in Weihai is rented and how it has been generated and operated, as well as the research materials, research results and present situation of the related issues, and points out this article. The uniqueness and purpose of the study;
The research part of the land law system details what kind of legal system has been established by the British people on the land of the Weihai Wei. What is the content of the system and what features it has, that is, "two yuan" is stored in the land law system of the British rented Weihai Wei.
The study of "land legal order" discusses how the British people establish legal order on the land of Weihai Wei according to the legal system, and the real reason for their existence, that is, the existence and reasons of the existence of "two yuan" in the land law order in Weihai.
On the basis of the previous research, the study of the "legal order" demonstrates that the reasons for the formation of the legal order of the British rented Weihai Wei are not essentially different from the legal order of the land. They have a common approach, further emphasizing the reasons for the formation of the legal order, and pointing out the modernization light brought to the Weihai Wei by this order.
The article points out that the reason of the construction and formation of the legal order in history is only the choice of the people in the "occasion" to recognize the strategy of interest based on the conflict and conflict, and this choice in "the other time" has played a kind of transformation of the traditional effect.
At the same time, this article also wants to emphasize that the study of law and even the rule of law cannot focus on the word rhetoric or "doctrine". The law is not only realistic, but also historical. We only go deep into history and carefully observe the "survival and death" of the law in history, and we can understand the true meaning of the law and study our research. The real value can also be found.
There is no philosophical starting point or methodology in this article. I have no understanding of it, but it is not possible to use it deliberately. It is only in the process of reading these files that the existence of these "continuous" and "breakages", as well as the contradictions and conflicts, are found and the reasons for their "existence" and their occurrence are studied.
History is not only "free", but also "introspection". The alternation of big history and small history, the alternation between the big pattern and the small pattern may make us have the opportunity to see how the reform of the whole legal order can be realized through the study of the law history of Weihai.
