本文選題：法律信仰 + 法律理性��； 參考：《河南大學(xué)》2010年碩士論文

【摘要】： 改革開(kāi)放以來(lái),法治一直是我們國(guó)家和社會(huì)關(guān)注的熱點(diǎn),這一點(diǎn),單從近幾年我國(guó)法學(xué)專(zhuān)業(yè)的熱門(mén)程度就可以看出。從頭些年的“法律必須被信仰,否則形同虛設(shè)”,到這些年的“依法治國(guó),建設(shè)法治型國(guó)家”的嘹亮口號(hào),我們始終對(duì)法律懷有一種難以割舍的情懷。 我們內(nèi)心信仰法律,可是現(xiàn)實(shí)生活中又出現(xiàn)著種種法律不被信仰的表現(xiàn),究竟我們對(duì)待法律應(yīng)懷有一種怎樣的態(tài)度,法律能否被信仰,法律信仰的含義是什么?法律被信仰的法律基礎(chǔ)何在?社會(huì)基礎(chǔ)又有哪些呢?作為一名法學(xué)學(xué)科的學(xué)生,這些問(wèn)題始終縈繞在我的腦海里,促使我不斷想弄明白這其中的原委。于是,我選擇了法律信仰這一命題作為我碩士學(xué)位論文的研究課題。 關(guān)于法律信仰的命題是一個(gè)大課題,許多名家學(xué)者都已有過(guò)許多論說(shuō)著述,這讓我有了更多的素材去了解這一課題的豐富內(nèi)容,與此同時(shí),也讓我對(duì)于本文的創(chuàng)新之處頗下了一番功夫。文章整體是這樣布局的: 第一部分:提出法律信仰命題的由來(lái),有兩種提法,一種認(rèn)為是源自西方的信仰命題,一種認(rèn)為是中國(guó)人自己的創(chuàng)造,但終歸是,我國(guó)應(yīng)該存在法律信仰,法律信仰在我國(guó)出場(chǎng)有其必然性和偶然性兩方面的因素。 第二部分:我從一個(gè)新的角度,分別解釋了法律和信仰各自的含義,又以自己的理解,詮釋了區(qū)別于西方社會(huì)的我國(guó)的法律信仰的真正含義,認(rèn)為法律信仰既是指人們對(duì)現(xiàn)行法律規(guī)范背后的法的價(jià)值或稱(chēng)為理想之法的一種理性的信奉和景仰,又指現(xiàn)實(shí)社會(huì)中人們對(duì)現(xiàn)行具體的法律規(guī)范的理性遵從和信服,它包含主觀和客觀兩個(gè)方面的內(nèi)容,具有理想性和理性兩個(gè)特點(diǎn)。 第三部分:是本文的重點(diǎn)章節(jié)之一,在倡導(dǎo)依法治國(guó)的今天,雖然法律的重要性已經(jīng)在人們心中逐漸提升了,可是現(xiàn)實(shí)生活中還是存在著法律信仰缺失的表現(xiàn),我主要列舉了在我國(guó)立法、司法、執(zhí)法和守法等領(lǐng)域出現(xiàn)的問(wèn)題,這些使得塑造我國(guó)法律信仰的法律基礎(chǔ)成為必要。我國(guó)法律信仰的法律基礎(chǔ)主要包括制度基礎(chǔ)和實(shí)踐基礎(chǔ)。 第四部分:也是本文的重點(diǎn)章節(jié)之一,即我國(guó)法律信仰的社會(huì)基礎(chǔ)。在這一章節(jié)里,我主要具體分析了我國(guó)法律信仰的社會(huì)基礎(chǔ),即積極的法律情感的主觀心理基礎(chǔ)和以優(yōu)秀的傳統(tǒng)倫理道德和法律文化為內(nèi)在支撐的社會(huì)文化基礎(chǔ)。 結(jié)語(yǔ):在文章的結(jié)尾部分,明確指出在我國(guó)法律信仰的形成需要社會(huì)多方面的合力,是各種社會(huì)因素和法律因素綜合作用的結(jié)果。并且表明了法律信仰命題在我國(guó)所具有的深遠(yuǎn)意義和作用。
[Abstract]:Since the reform and opening up, the rule of law has always been a hot spot in our country and society, which can be seen from the hot degree of law specialty in our country in recent years."the law must be believed in from the beginning of the year, or else it is virtually empty," and to the loud slogan of "ruling the country according to law and building a country ruled by law," we have always had an indelible feeling for the law.We believe in the law, but in real life, there are a variety of laws are not believed in the performance, after all we should have a kind of attitude to the law, whether the law can be believed, what is the meaning of legal faith?What is the legal basis for the belief of law?What are the social foundations?As a law student, these questions lingered in my mind, prompting me to keep trying to figure out what was going on.Therefore, I chose the proposition of legal belief as my research topic.The proposition of legal belief is a big topic, and many famous scholars have already written a lot, which gives me more material to understand the rich content of this subject, at the same time,Also let me on the innovation of this article quite a lot of effort.The overall layout of the article is as follows:The first part: put forward the origin of the proposition of legal belief, there are two formulations, one is that it originated from the western belief proposition, the other is that it is the creation of the Chinese people themselves, but in the end, there should be legal faith in our country.There are two factors in the appearance of legal belief in our country: inevitability and fortuitousness.The second part: from a new angle, I explain the meaning of law and faith, and with my own understanding, I interpret the true meaning of legal belief in our country, which is different from the western society.The author holds that legal belief is not only a kind of rational belief and admiration for the value of the law behind the current legal norms, or ideal law, but also the rational adherence and conviction of people to the existing specific legal norms in the real society.It contains subjective and objective aspects of the content, with ideal and rational two characteristics.The third part is one of the key chapters of this paper. Today, when we advocate governing the country by law, although the importance of law has been gradually raised in people's minds, there is still a lack of legal belief in real life.I mainly enumerate the problems in the fields of legislation, judicature, law enforcement and abiding by the law, which make it necessary to shape the legal basis of our country's legal belief.The legal basis of legal belief in China mainly includes the institutional basis and the practical basis.The fourth part is one of the key chapters of this paper, namely the social foundation of legal belief in our country.In this chapter, I mainly analyze the social basis of legal belief in our country, that is, the subjective psychological basis of positive legal emotion and the social and cultural foundation supported by excellent traditional ethics and legal culture.Conclusion: at the end of the article, it is clearly pointed out that the formation of legal belief in our country needs the resultant force of various aspects of society, which is the result of the comprehensive action of various social and legal factors.It also shows the profound significance and function of the proposition of legal belief in our country.
