【摘要】：中國(guó)正處于轉(zhuǎn)型復(fù)興的關(guān)鍵時(shí)期，法治建設(shè)也伴隨著這個(gè)時(shí)期經(jīng)濟(jì)社會(huì)發(fā)展和改革開(kāi)放的歷史進(jìn)程發(fā)生著深刻變化。本文以改革開(kāi)放以來(lái)的中國(guó)法律文化發(fā)展為主題，以轉(zhuǎn)型為主線，，在對(duì)法律文化深度轉(zhuǎn)型有一個(gè)全景式的描述和背景分析的基礎(chǔ)上，著重梳理法律理論轉(zhuǎn)型、法律制度轉(zhuǎn)型和法律實(shí)踐轉(zhuǎn)型的脈絡(luò)，對(duì)司法獨(dú)立、多元法律體系、“活法”、立法民主化等一些法治建設(shè)中的重點(diǎn)關(guān)節(jié)進(jìn)行較為客觀詳細(xì)的考察，試圖描繪出一幅脈絡(luò)清晰且血肉豐滿(mǎn)的圖畫(huà)，在這幅圖畫(huà)中我們不僅可以清楚地看到這個(gè)時(shí)期的客觀變化，更為重要的是可以從這些變化中總結(jié)出一些規(guī)律，以此為基礎(chǔ)，對(duì)把握未來(lái)中國(guó)的法治發(fā)展走向及重點(diǎn)任務(wù)進(jìn)行探索，以期為各方提供一些預(yù)測(cè)和參考。
[Abstract]:China is in the crucial period of transformation and rejuvenation, and the construction of rule of law is accompanied by profound changes in the historical process of economic and social development and reform and opening up.This article takes the development of Chinese legal culture since the reform and opening up as the theme, takes the transformation as the main line, on the basis of a panoramic description and background analysis of the deep transformation of the legal culture, focuses on combing the transformation of the legal theory.In the context of the transformation of the legal system and the legal practice, the author makes an objective and detailed investigation of the key joints in the construction of the rule of law, such as judicial independence, pluralistic legal system, "living law", and the democratization of legislation, etc.Trying to draw a picture of a clear and fleshy picture, in which we can clearly see not only the objective changes of this period, but also, more importantly, that we can sum up some laws from these changes as a basis for this.This paper probes into the development trend and key tasks of China's rule of law in the future in order to provide some prediction and reference for all parties.
