【摘要】： 1941年12月8日太平洋戰(zhàn)爭(zhēng)爆發(fā)之后,由于受到日本侵略者的不斷滲透,上海法租界的法制建設(shè)在此前后發(fā)生了一些從體制到內(nèi)容的變化。對(duì)此,本文著力探討的是,在太平洋戰(zhàn)爭(zhēng)爆發(fā)之后,法租界法制在日本侵略者的操控與影響下發(fā)生了怎樣的變化?其特點(diǎn)如何?如何評(píng)價(jià)這一時(shí)期的法制變異?其對(duì)今天存在怎樣的啟示意義?當(dāng)時(shí)的法租界公董局,在法租界最后三年這一特殊歷史時(shí)期中扮演了一個(gè)什么樣的角色?這些都是本文試圖回答的問題。 本文包括了導(dǎo)言、正文和結(jié)語三個(gè)部分。其中,正文又分為三章。 導(dǎo)言部分,筆者首先對(duì)本文所指的最后三年進(jìn)行了時(shí)間上的界定,以明確本文研究的時(shí)間范圍。然后從選題的目的出發(fā),闡明本文的研究價(jià)值與意義所在。最后,筆者就與本文相關(guān)的學(xué)術(shù)文獻(xiàn)和研究現(xiàn)狀進(jìn)行了簡要的說明,并介紹了本文所使用的史料來源。 正文部分,第一章主要介紹上海法租界最后三年法制機(jī)構(gòu)的變異。在這一章中,筆者分別從原有法制機(jī)構(gòu)與新設(shè)法制機(jī)構(gòu)入手,對(duì)原有各機(jī)構(gòu)在這一歷史時(shí)期中發(fā)生的變異以及這一時(shí)期中新設(shè)的法制機(jī)構(gòu)進(jìn)行了著重考察,從中可以看出這種變異背后所體現(xiàn)出的權(quán)力角逐的結(jié)果。 第二章主要介紹上海法租界最后三年法制內(nèi)容的變異。日本帝國主義為適應(yīng)其侵略戰(zhàn)爭(zhēng)的需要對(duì)法租界的立法活動(dòng)實(shí)施間接操控,不斷施加影響,使得這一時(shí)期的法制內(nèi)容帶有明顯的法西斯專政所獨(dú)有的野蠻落后的一面。有鑒于此,筆者在史料的基礎(chǔ)上,通過對(duì)這一歷史時(shí)期內(nèi)法租界浩繁如織的法令進(jìn)行整理和歸納,分公董局新規(guī)定與日軍司令部公告兩大類,從政治、經(jīng)濟(jì)等多個(gè)角度對(duì)法租界最后三年的法制概貌進(jìn)行詳細(xì)介紹。 最后一章即第三章,是在分析第一、二章的基礎(chǔ)上進(jìn)行理論升華,通過對(duì)比、歸納和分析,概括出日偽時(shí)期上海法租界法制變異后的特點(diǎn)、評(píng)析及對(duì)今天的啟示,并據(jù)此得出最終結(jié)論。
[Abstract]:After the Pacific War broke out on December 8, 1941, due to the continuous infiltration of the Japanese invaders, the legal construction of the Shanghai French concession changed from the system to the content before and after that.In this regard, this paper focuses on how the French concession law changed under the control and influence of the Japanese aggressors after the Pacific War broke out.What are their characteristics?How to evaluate the variation of legal system in this period?What enlightenment does it have on today?What role did the French concession board play in the special historical period of the last three years of the French concession?These are the questions this paper tries to answer.This paper includes three parts: introduction, text and conclusion.Among them, the text is divided into three chapters.In the introduction part, the author defines the time of the last three years in order to define the time range of this paper.Then, from the purpose of choosing the topic, this paper clarifies the value and significance of the research.Finally, the author gives a brief explanation of the academic literature and research status, and introduces the sources of historical materials used in this paper.The first chapter mainly introduces the variation of the legal system in the last three years of Shanghai French concession.In this chapter, the author starts with the existing legal institutions and the newly established legal institutions, and focuses on the variation of the existing institutions in this historical period and the newly established legal institutions in this period.From this we can see the result of the power struggle behind the variation.The second chapter mainly introduces the variation of the legal content in the last three years of Shanghai French concession.In order to adapt to the need of the war of aggression, the Japanese imperialists carried out indirect manipulation and influence on the legislative activities of the French concession, which made the legal content of this period have the barbaric backwardness unique to the fascist dictatorship.In view of this, the author, on the basis of historical data, through sorting out and summing up the numerous decrees of the French concession during this historical period, divided the new regulations of the Public Office of the Board of Directors and the announcement of the Japanese Army Command into two major categories, from the political perspective.Economic and other aspects of the French concession in the last three years of the legal overview of the detailed introduction.The last chapter, the third chapter, is based on the analysis of the first and second chapters of the theoretical sublimation, through comparison, induction and analysis, summarized the changes in the legal system of the French concession in Shanghai during the period of the Japanese puppet, the characteristics, analysis and today's enlightenment.Based on this, the final conclusion is drawn.
