【摘要】：分析和解決社會(huì)問題有多種進(jìn)路。法經(jīng)濟(jì)學(xué)仰仗其強(qiáng)大的解釋力和不斷自我升級(jí)的活力,為分析社會(huì)問題提供了一種新穎實(shí)用的視角。我們可以運(yùn)用法經(jīng)濟(jì)學(xué)的分析范式研究禁止兒童乞討的問題。兒童乞討問題受到社會(huì)各界廣泛關(guān)注。有人建議立法干預(yù),甚至全面禁止兒童乞討。通過法經(jīng)濟(jì)學(xué)的視角可以剖析兒童乞討問題的社會(huì)根源,并就制度設(shè)計(jì)過程中需要界清的有關(guān)概念以及各種社會(huì)成本與收益進(jìn)行分析,進(jìn)而按照法經(jīng)濟(jì)學(xué)的評(píng)價(jià)體系對(duì)各種主張進(jìn)行考察,從技術(shù)層面與國際比較的層面上對(duì)禁止兒童乞討作出制度設(shè)計(jì)或改進(jìn)方面的具體分析與建議。
[Abstract]:There are many ways to analyze and solve social problems.Law and economics rely on its strong explanatory power and the vitality of self-upgrading, which provides a new and practical perspective for the analysis of social problems.We can use the analytical paradigm of law and economics to study the prohibition of child begging.The problem of child begging has received wide attention from all walks of life.It is suggested that legislation should intervene, or even prohibit child begging altogether.Through the perspective of law and economics, we can analyze the social root of the problem of begging of children, and analyze the relevant concepts and various social costs and benefits in the process of system design.Then according to the evaluation system of law and economics, the author makes a detailed analysis and suggestions on the system design or improvement of the prohibition of child begging from the technical level and the international comparison level.
