【摘要】： 本文取材于現(xiàn)實(shí)生活中一個(gè)真實(shí)的案例,筆者根據(jù)檢察機(jī)關(guān)對(duì)被告賈某起訴的四項(xiàng)罪名中所涉及的刑事法律問(wèn)題有所節(jié)選的進(jìn)行了討論。筆者以賈某的每一項(xiàng)罪名為基礎(chǔ),在提出案情疑問(wèn)的同時(shí)運(yùn)用自己所學(xué)的和從參考文獻(xiàn)中借鑒的知識(shí)對(duì)疑點(diǎn)問(wèn)題給出了自己的觀點(diǎn)和評(píng)述,同時(shí)針對(duì)本案中出現(xiàn)的新問(wèn)題、新情況提出了自己的建議和看法。本文所涉及的刑事司法問(wèn)題不僅包含了刑法總則和分則的問(wèn)題,還包括了實(shí)體法和程序法的問(wèn)題。筆者希望借此文章,對(duì)案件中涉及的一些刑法問(wèn)題做一個(gè)簡(jiǎn)單的探討。
[Abstract]:Based on a real case in real life, the author discusses the criminal legal issues involved in the four charges indicted by the defendant Jia.On the basis of every charge of Jia Mou, the author puts forward his own views and comments on the doubtful points by using the knowledge he has learned and the knowledge he has learned from the reference literature while raising questions about the case, and at the same time, aiming at the new problems that appear in this case,The new situation puts forward its own suggestions and opinions.The criminal justice issues involved in this paper include not only the general principles and sub-rules of criminal law, but also substantive law and procedural law.The author hopes to use this article to make a brief discussion on some criminal law problems involved in the case.
