【摘要】：薄弱學校改進有賴于法律提供保障,而問責又是薄弱學校改進法律保障體系不可或缺的內(nèi)容。薄弱學校委托管理的根基是市場化和公益信托,強有力的問責機制是其成敗的關鍵�；谛磐袡C制的特許學校政策是美國改進薄弱學校的主要措施,美國允許開辦特許學校的州均頒布了《特許學校法》。由于一些州《特許學校法》的問責條款不夠完善,導致法律的可操作性較弱,對不合格特許學校的問責未能落到實處,從而引起人們對特許學校這一改革措施成效的極大爭議。我國薄弱學校改進中的"委托管理"也面臨著法律保障的問題,美國《特許學校法》的經(jīng)驗與教訓可以為我們提供些許借鑒與啟示。
[Abstract]:The improvement of weak schools depends on the protection of laws, and accountability is an indispensable part of the legal security system of weak schools. The foundation of entrusted management of weak schools is marketization and public trust. Strong accountability mechanisms are key to success or failure. Fiduciary based charter school policies are a major measure to improve weak schools in the United States. All the states in the United States that allow the operation of charter schools have promulgated the Charter Schools Act. Due to the inadequate accountability provisions of the charter schools law in some states, the operation of the law is weak, and the accountability of unqualified charter schools has not been implemented. This has caused great controversy about the effectiveness of the reform measures of charter schools. The "entrustment management" in the improvement of weak schools in our country is also facing the problem of legal guarantee. The experience and lessons of the United States Charter School Act can provide us with some reference and enlightenment.
