【摘要】: 從皇權(quán)的角度說,凡是意圖挑戰(zhàn)和危害皇權(quán)的犯罪都可以稱為侵害皇權(quán)罪,因此侵害皇權(quán)罪的所指非常廣泛,主要包括《唐律》十惡中的“謀反”、“謀大逆”、“謀叛”、“大不敬”四項以及非十惡中的“造妖書妖言”等。 《唐律》作為中國古代法律的典范,深受儒家思想影響,依禮制律,失禮則入刑,禮刑相互結(jié)合,有“一準(zhǔn)乎禮”之譽。侵害皇權(quán)罪嚴(yán)重違背禮教精神,因此《唐律》對侵害皇權(quán)罪明確立法,并給予嚴(yán)厲的懲罰。本文旨在通過對《唐律》中侵害皇權(quán)罪法律具體規(guī)定的敘述,相關(guān)案例的分析和歷史淵源的追溯,揭示《唐律》從立法原則到司法實踐皆刻意維護皇權(quán)統(tǒng)治的階級本質(zhì)。
[Abstract]:From the perspective of imperial power, any crime intended to challenge and endanger imperial power can be called the crime of infringing upon imperial power. Therefore, the crime of infringing upon imperial power is widely referred to. It mainly includes "rebellion", "connivance", "conspiracy against", "great disrespect" and "creating evil words" in ten evils of Tang Dynasty. As an example of ancient Chinese law, Tang Law was deeply influenced by Confucian thought. According to the rules of etiquette, impolite punishment was punished, and the ceremony and punishment were combined with each other. The crime of infringing upon the imperial power seriously violated the spirit of etiquette and education, and the crime of infringing upon the imperial right seriously violated the spirit of propriety. Therefore, Tang Law clearly legislates the crime of infringing upon the imperial power and gives severe punishment. This article aims to analyze the relevant cases and trace back the historical origin through the description of the specific provisions of the law on the crime of infringing the imperial power in the Tang Law, the analysis of the relevant cases and the tracing of the historical origin. It reveals that from the legislative principle to judicial practice, Tang Law deliberately maintains the class essence of imperial rule.
