【摘要】：國(guó)內(nèi)很多權(quán)威的法學(xué)著作認(rèn)為公法與私法的區(qū)分在英美法系國(guó)家不存在,這是不符合當(dāng)代英美法事實(shí)的,因?yàn)楫?dāng)下它們也存在這種區(qū)分。公法與私法的區(qū)分其實(shí)可以從三個(gè)層次的標(biāo)準(zhǔn)來(lái)判斷,而且可以把判斷標(biāo)準(zhǔn)分為強(qiáng)標(biāo)準(zhǔn)、弱標(biāo)準(zhǔn)。如果同時(shí)存在公法元素與私法元素則不宜像德國(guó)一樣全部定性為公法而宜根據(jù)矛盾的主要方面來(lái)決定矛盾的性質(zhì)。政府購(gòu)買(mǎi)公共服務(wù)不同于傳統(tǒng)市場(chǎng)供給機(jī)制也不同于政府直接供給機(jī)制,其中政府、服務(wù)機(jī)構(gòu)、服務(wù)對(duì)象之間三維關(guān)系的公法、私法性質(zhì)并不明顯,應(yīng)根據(jù)三個(gè)層次標(biāo)準(zhǔn)系統(tǒng)甄別定性。
[Abstract]:Many authoritative legal works in China hold that the distinction between public law and private law does not exist in Anglo-American law countries, which is not in line with the facts of contemporary Anglo-American law. The distinction between public law and private law can actually be judged from three levels of standards, and can be divided into strong standards. If there are elements of public law and private law at the same time, it should not be characterized as public law as in Germany, but the nature of contradiction should be determined according to the main aspects of contradiction. The purchase of public services by the government is different from that of the traditional market. The giving mechanism is also different from the direct supply mechanism of the government. The nature of public law and private law of the three-dimensional relationship among government, service organization and service object is not obvious, and should be identified according to the three-level standard system.
