【摘要】： 蘇聯(lián)解體后,俄羅斯的經(jīng)濟(jì)、政治等方面都發(fā)生了劇烈的變化。同時,西方國家關(guān)于人權(quán)的進(jìn)步理論也蜂擁進(jìn)入俄羅斯,以此為基礎(chǔ),憲法基本權(quán)利規(guī)范直接效力在1993年俄羅斯憲法中得到確立。俄羅斯的憲法基本權(quán)利規(guī)范直接效力具有理論和規(guī)范兩種意義上的內(nèi)涵,無論是哪一種意義上的直接效力都為俄羅斯的法治國家建設(shè)帶來了顯著的影響。當(dāng)然,在憲法基本權(quán)利規(guī)范直接效力適用的過程中也暴露出了其面臨的困境。 雖然俄羅斯的這一制度并不完美,還有待在民主法治的進(jìn)程中不斷發(fā)展和完善,但其中所貫穿的保障人權(quán)的理念和與時俱進(jìn)、切合實(shí)際的法學(xué)研究精神等對于我國來說都是寶貴的經(jīng)驗(yàn)。本文力圖通過對俄羅斯憲法基本權(quán)利直接效力及其適用模式的研究,為我國探尋有效的憲法基本權(quán)利直接效力的適用途徑帶來啟示。
[Abstract]:After the collapse of the Soviet Union, Russia's economy, politics and other aspects have undergone drastic changes. At the same time, Western progressive theories on human rights have also flocked to Russia, on the basis of which, The direct effect of constitutional basic rights norms was established in the Russian Constitution in 1993. No matter in any sense, the direct effect has brought significant influence to the construction of Russia's country ruled by law. Of course, in the process of applying the direct effect of constitutional basic rights and norms, it has also exposed the dilemma it is facing. Although this system in Russia is not perfect and has yet to be continuously developed and perfected in the process of democracy and the rule of law, the concept of guaranteeing human rights, which runs through it, and keeps pace with the times, The practical spirit of legal research is a valuable experience for our country. This paper tries to study the direct effect of the fundamental rights of the Russian Constitution and its applicable mode. For our country to explore effective constitutional basic rights direct effect of the application of the approach to bring inspiration.
