【摘要】：歐洲刑事政策在歐洲市場(chǎng)一體化的背景中獲得關(guān)注。歐洲刑事政策一體化表現(xiàn)在兩個(gè)方面:歐洲法律的刑事化,即歐洲共同體、歐盟層面刑事法律規(guī)范的擴(kuò)張和限制;刑事法律的歐洲化,即各成員國(guó)刑事法律對(duì)歐洲統(tǒng)一、共同的刑事標(biāo)準(zhǔn)的反應(yīng),前者集中體現(xiàn)為一體化,后者集中體現(xiàn)為一體化語(yǔ)境下的多元化�！独锼贡緱l約》確立的多數(shù)表決立法機(jī)制為歐洲超國(guó)家的刑事實(shí)體法和刑事程序法的發(fā)展提供了空間,一方面可能導(dǎo)致歐洲刑事立法擴(kuò)張的風(fēng)險(xiǎn),另一方面成員國(guó)為了維護(hù)自身的身份濫用防衛(wèi)機(jī)制可能導(dǎo)致歐盟刑事立法的癱瘓。歐洲刑事政策一體化有助于解決這樣的矛盾,為合理控制并引導(dǎo)歐洲的刑事立法和實(shí)踐提供可靠的途徑。
[Abstract]:European criminal policy is concerned in the background of European market integration. European criminal policy integration is manifested in two aspects: the criminalization of European law, that is, the European Community, the expansion and restriction of criminal law norms in the European Union; The Europeanization of criminal law, that is, the reaction of the criminal laws of each member country to the European unity and common criminal standards, the former concentrated on integration, The latter embodies the pluralism in the context of integration. The majority voting legislative mechanism established by the Lisbon Treaty provides space for the development of the substantive criminal law and the criminal procedure law of the European supranational countries. On the one hand, it may lead to the risk of the expansion of European criminal legislation; on the other hand, the abuse of defence mechanisms by member States in order to safeguard their identity may lead to the paralysis of EU criminal legislation. European criminal policy integration will help to resolve such contradictions. To provide a reliable way to reasonably control and guide European criminal legislation and practice.
