【摘要】： 任何一種法學(xué)理論的構(gòu)建都要建立在對(duì)法的本質(zhì)認(rèn)識(shí)之上。法的本質(zhì)問題是法理學(xué)首要的基本問題,對(duì)于認(rèn)識(shí)和理解法律以及進(jìn)一步促進(jìn)中國法學(xué)理論的發(fā)展具有重要意義。近年來,圍繞著法的本質(zhì)問題,我國法學(xué)理論界展開了一系列激烈的討論,形成了諸多關(guān)于法的本質(zhì)的觀點(diǎn)與學(xué)說。這些關(guān)于法本質(zhì)的觀點(diǎn)與學(xué)說對(duì)于進(jìn)一步探究和完善當(dāng)代中國法本質(zhì)觀給予了很大程度的啟迪。 本文首先從分析“本質(zhì)”這一哲學(xué)上的概念入手進(jìn)而對(duì)法的本質(zhì)進(jìn)行了闡釋。在考察了西方法本質(zhì)觀的歷史流變之后,本文論證了法的本質(zhì)觀屬于社會(huì)意識(shí)的范疇,具有歷史變遷性,它隨著時(shí)代的發(fā)展而不斷變化。接著,本文對(duì)我國學(xué)者關(guān)于法本質(zhì)的觀點(diǎn)進(jìn)行了歸納和總結(jié),并且對(duì)“統(tǒng)治階級(jí)意志論”、“階級(jí)性與社會(huì)性相統(tǒng)一的法本質(zhì)論”、“法本質(zhì)虛無論”和“利益關(guān)系調(diào)整論”逐一進(jìn)行了評(píng)析。在對(duì)我國學(xué)者關(guān)于法本質(zhì)的觀點(diǎn)進(jìn)行分析并合理借鑒各家研究成果的基礎(chǔ)上,本文分別從法的表現(xiàn)形式、法的調(diào)整功能和法的效力來源這三個(gè)方面提煉出當(dāng)代中國法律中的三個(gè)基本因素：規(guī)范因素、利益調(diào)整因素和人民意志因素。最后,根據(jù)“事物的本質(zhì)是事物基本因素的綜合”這一馬克思主義原理,本文認(rèn)為：當(dāng)代中國法的本質(zhì)是以人民意志形式表現(xiàn)出來的,對(duì)當(dāng)代中國社會(huì)中一系列利益關(guān)系進(jìn)行調(diào)整的社會(huì)規(guī)范的總和。
[Abstract]:The construction of any kind of legal theory should be based on the understanding of the essence of law. The essence of law is the primary basic problem of jurisprudence. It is of great significance to understand and understand the law and to further promote the development of Chinese legal theory. In recent years, a series of heated discussions have been held in the field of legal theory, focusing on the essence of law. Many views and theories on the essence of law have been formed, which have greatly inspired the further exploration and improvement of the essence of law in contemporary China. This paper begins with the philosophical concept of "essence" and then explains the essence of law. After examining the historical evolution of the western view of the essence of law, this paper demonstrates that the concept of essence of law belongs to the category of social consciousness. It changes with the development of the times. Then, this paper sums up and summarizes the views of Chinese scholars on the essence of law. It also analyzes "the will of the ruling class", "the unity of class nature and sociality", "the virtual nature of law" and "the adjustment of interest relationship" one by one. In this paper, the views of Chinese scholars on the essence of law are divided. Based on the analysis and reasonable reference of various research results, This paper abstracts three basic factors in contemporary Chinese law from three aspects: the manifestation of law, the adjustment function of law and the source of its validity: normative factor, interest adjustment factor and people's will factor. According to the Marxist principle that "the essence of things is the synthesis of basic factors of things", this paper holds that the essence of contemporary Chinese law is manifested in the form of the will of the people. The sum of social norms that regulate a series of interests in contemporary Chinese society.
