【摘要】： 作為實現(xiàn)對外政策目標的工具,經(jīng)濟制裁在美國的對外政策體系中擁有重要地位,美國為有效實施經(jīng)濟制裁建立了較為完備的法律體系和運行機制。從法律角度對美國經(jīng)濟制裁進行分析,詳盡了解其法律淵源、實體規(guī)則以及實踐中存在的法律爭議,對于我國有效應對乃至合理應用經(jīng)濟制裁可提供有益的思路。 本篇論文主體部分共為四章。第一章,論文主要論述了經(jīng)濟制裁的一些基本理論問題,包括經(jīng)濟制裁的定義、與相關概念的聯(lián)系及區(qū)別以及美國實施經(jīng)濟制裁的動因與政策目標等;第二章,論文將美國經(jīng)濟制裁的相關法律淵源分為授權制裁、直接制裁和輔助制裁三種類型,對其實體規(guī)則和主要實踐進行了較為詳盡的分析;第三章,論文針對美國經(jīng)濟制裁在實踐中所面臨的適用限制,從國際法和國內(nèi)法兩個層面進行了闡述;第四章,在介紹了美國經(jīng)濟制裁的發(fā)展趨勢后,論文就美國經(jīng)濟制裁對我國的啟示從借鑒和應對兩個方面進行了分析。
[Abstract]:As a tool to achieve foreign policy objectives, economic sanctions play an important role in the foreign policy system of the United States. The United States has established a relatively complete legal system and operating mechanism for the effective implementation of economic sanctions. It can provide useful ideas for our country to deal with and even apply economic sanctions reasonably. The main body of this paper is composed of four chapters. The first chapter mainly discusses some basic theoretical issues of economic sanctions, including the definition of economic sanctions. The relation and difference with related concepts, the motivation and policy goal of economic sanctions in the United States etc. In chapter two, the related legal sources of economic sanctions in the United States are divided into three types: authorized sanctions, direct sanctions and supplementary sanctions. The article analyzes its substantive rules and main practices in detail. Chapter three, aiming at the application limits of American economic sanctions in practice, expounds them from the two aspects of international law and domestic law. Chapter 4th, After introducing the development trend of American economic sanctions, the paper analyzes the enlightenment of American economic sanctions to our country from two aspects: reference and response.
