【摘要】： 法實證主義的理論根基主要體現(xiàn)在三個方面:一是法實證主義的思想史根源;二是法實證主義賴以存立的“人類形象”的建構;三是法實證主義的方法論特質。 休謨和康德的認識論說明了法實證主義所強調的實證性乃是知識的實證性,從而區(qū)別于社會法學派的社會的實證性和歷史法學派的歷史的實證性。霍布斯則在主權和實在法之間建立了內在關聯(lián),從而為主權概念作為法實證主義理論中的核心概念奠定了基礎。在堅實的歷史淵源之上,法實證主義者從各自不同的立場出發(fā),通過不同方法的采用,對其理論所賴以存立的“人類形象”的建構也存在著深刻的不同,從邊沁、奧斯丁的功利化的個人到凱爾森的符號意義上的個人,再到哈特的去功利化的個人,法實證主義所建構“人類形象”在“個人”的理念下不斷地改變�；跉v史和“人類形象”的雙重基礎,最能夠體現(xiàn)和捍衛(wèi)法實證主義的理論根基的,乃是法實證主義自身所具有的方法論特質。這一方法論特質以事實與價值的分離和法律作為一個封閉的邏輯自足體為前提預設,以學者們所采用的不同方法為基本展開。邊沁、奧斯丁的理想語言方法和一般功利方法捍衛(wèi)了他們的價值無涉的基本立場;凱爾森的純粹方法和先驗論證方法以及哈特的日常語言方法和描述社會學方法在捍衛(wèi)了他們價值中立的立場;由于采用了上述不同的方法,學者們之間的理論也是存在著深刻的差異的,比如在規(guī)范的基礎和規(guī)范的聯(lián)結方式上就存在著諸多不同。
[Abstract]:The theoretical foundation of legal positivism is mainly embodied in three aspects: first, the idea of legal positivism; Shi Genyuan, the two is the construction of "human image" based on legal positivism; the three is the methodological characteristics of legal positivism.
