【摘要】：高發(fā)的訴訟頻率、高額的賠償金額、高昂的制度成本、有限的制度效果以及對(duì)醫(yī)療責(zé)任保險(xiǎn)、健康保險(xiǎn)和醫(yī)療服務(wù)提供者產(chǎn)生的負(fù)面影響是美國(guó)政府改革醫(yī)療過(guò)失訴訟制度的主要成因。為此,美國(guó)各州如加利福尼亞州積極采取各種措施,推動(dòng)醫(yī)療過(guò)失訴訟制度改革,取得了一定效果。為應(yīng)對(duì)各種新舊問(wèn)題,美國(guó)針對(duì)醫(yī)療過(guò)失訴訟制度的下一步改革將會(huì)集中在提高醫(yī)療訴訟進(jìn)入法院的門(mén)檻、增加患方勝訴的難度、限制醫(yī)療損害賠償金的無(wú)序增長(zhǎng)以及變革傳統(tǒng)的醫(yī)療侵權(quán)責(zé)任等方面。我國(guó)應(yīng)重視醫(yī)療過(guò)失訴訟制度對(duì)健康保險(xiǎn)的負(fù)面影響,改革開(kāi)放式的醫(yī)療過(guò)失訴訟制度,推進(jìn)醫(yī)療損害賠償特別立法并適度限制賠償金的額度。
[Abstract]:High litigation frequency, high compensation, high system cost, limited system effect and medical liability insurance, The negative impact of health insurance and medical service providers is the main cause of the United States government's reform of the medical negligence litigation system. For this reason, States in the United States, such as California, have actively taken various measures to promote the reform of the medical negligence litigation system. Some results have been achieved. In order to deal with all kinds of new and old problems, the next step in the reform of the medical negligence litigation system in the United States will focus on raising the threshold for medical litigation to enter the court and making it more difficult for the patient to win the lawsuit. To limit the disorderly growth of medical damages and to reform the traditional medical tort liability, China should pay attention to the negative effects of medical negligence litigation system on health insurance, and reform and opening up medical negligence litigation system. To promote special legislation on medical damages and limit the amount of compensation.
