【摘要】： 隨著經(jīng)濟、科學一體化進程的不斷發(fā)展,一個國家科技創(chuàng)新能力的強弱日益成為主導國家競爭和世界格局的重要影響因素。鑒于科技創(chuàng)新在國家發(fā)展和進步中的重要作用,世界各主要國家都將科技創(chuàng)新作為國家戰(zhàn)略,制定科技創(chuàng)新法律來引導、保障和促進本國科學研究。二戰(zhàn)后日本的經(jīng)濟取得了飛速增長,一越成為世界第二號經(jīng)濟大國,其完善的科技創(chuàng)新法律制度對日本國家科技進步和經(jīng)濟發(fā)展起了巨大的作用。 本文在國內(nèi)外現(xiàn)有理論和實踐的基礎(chǔ)上,全面系統(tǒng)地對日本的科技創(chuàng)新法律制度進行分析研究,并在此基礎(chǔ)上為我國科技創(chuàng)新法律制度的完善提出對策建議。本文首先從日本科技創(chuàng)新機構(gòu)法律制度、科技創(chuàng)新投入法律制度、科技創(chuàng)新成果法律制度、科技創(chuàng)新創(chuàng)新獎勵法律制度等方面入手,系統(tǒng)分析日本各法律制度的特點;其次,對日本科技創(chuàng)新法律制度的各部分進行評價,既分析其對日本科技創(chuàng)新活動的促進作用,也指出其存在的不足之處;最后,借鑒日本成功經(jīng)驗并結(jié)合我國科技創(chuàng)新法律中存在的不足,為我國科技創(chuàng)新法律制度的完善提出了加快科技創(chuàng)新研究機構(gòu)法律制度的建設(shè)、建立健全科技創(chuàng)新投入法律制度、完善科技成果保護制度、強化制度建設(shè),保障科技創(chuàng)新成果轉(zhuǎn)化、健全科技獎勵制度等對策建議。
[Abstract]:With the development of economy and science integration process, the strength of a country's science and technology innovation ability has become an important influence factor of leading national competition and the world pattern, in view of the important role of science and technology innovation in national development and progress, All major countries in the world regard science and technology innovation as a national strategy, formulate laws on science and technology innovation to guide, safeguard and promote their own scientific research. After World War II, Japan's economy has achieved rapid growth, becoming the second largest economy in the world. Its perfect legal system of science and technology innovation plays a great role in the development of science and technology and economy of Japan. Based on the existing theories and practices at home and abroad, this paper makes a comprehensive and systematic analysis and study of Japan's legal system of scientific and technological innovation. On this basis, the author puts forward the countermeasures and suggestions for the perfection of the legal system of scientific and technological innovation in China. Firstly, this paper starts with the legal system of Japan's scientific and technological innovation institutions, the legal system of scientific and technological innovation input, the legal system of scientific and technological innovation achievements. Starting with the legal system of scientific and technological innovation award, this paper systematically analyzes the characteristics of each legal system in Japan. Secondly, it evaluates the various parts of the legal system of science and technology innovation in Japan, which not only analyzes its role in promoting Japan's scientific and technological innovation. Finally, drawing lessons from Japan's successful experience and combining with the shortcomings of our country's science and technology innovation law, the author puts forward to accelerate the construction of the legal system of science and technology innovation research institution for the perfection of our country's science and technology innovation legal system. To establish and perfect the legal system of scientific and technological innovation input, to perfect the system of protecting scientific and technological achievements, to strengthen the system construction, to guarantee the transformation of scientific and technological innovation achievements, and to perfect the system of scientific and technological reward.
