【摘要】： 純經(jīng)濟(jì)損失是介于侵權(quán)法和合同法之間的一個前沿課題,它是對傳統(tǒng)民事賠償制度的重大修正,對于充分保障民事主體的經(jīng)濟(jì)利益具有重要意義。純經(jīng)濟(jì)損失是英美法上的一個常見概念,英美法對純經(jīng)濟(jì)損失的賠償已經(jīng)形成一套獨特的處理機(jī)制。大陸法系國家一般不使用純經(jīng)濟(jì)損失這一概念,但對這種損失也存在獨特的處理機(jī)制。純經(jīng)濟(jì)損失的研究在我國剛剛起步,但純經(jīng)濟(jì)損失在日常生活中卻大量發(fā)生,因此有必要對此展開研究。本文主要通過比較法研究,借鑒了兩大法系主要國家的經(jīng)驗,對純經(jīng)濟(jì)損失作出概念界定,分析了我國對純經(jīng)濟(jì)損失處理的現(xiàn)狀,并對未來我國建立純經(jīng)濟(jì)損失賠償制度進(jìn)行合理的制度設(shè)計。
[Abstract]:Pure economic loss is a frontier subject between tort law and contract law. It is a major amendment to the traditional civil compensation system. It is of great significance to fully protect the economic interests of civil subjects. Pure economic loss is a common concept in Anglo-American law. The compensation of pure economic loss in Anglo-American law has formed a unique mechanism. The concept of pure economic loss is not generally used in civil law countries. However, there is a unique mechanism to deal with this kind of loss. The study of pure economic loss is just beginning in our country, but the pure economic loss occurs in large quantities in our daily life, so it is necessary to study it. This paper draws lessons from the experience of the main countries of two legal systems, defines the concept of pure economic loss, analyzes the present situation of dealing with pure economic loss in our country, and designs a reasonable system for establishing the compensation system of pure economic loss in China in the future.
