【摘要】：正實(shí)效主義法學(xué)源于法律經(jīng)濟(jì)學(xué)中從實(shí)證到規(guī)范的思維方法,以皮爾斯的實(shí)效主義哲學(xué)為理論基礎(chǔ),基于法律效力的類型劃分,提出全新的法律概念,系統(tǒng)建構(gòu)社會(huì)變革時(shí)期中的立法方法和司法理論。法律人對(duì)法律經(jīng)濟(jì)學(xué)可能存在誤解,誤解的根源在于將波斯納的《法律的經(jīng)濟(jì)分析》作為法律經(jīng)濟(jì)學(xué)的范式。首先,必須區(qū)分科斯式法律經(jīng)濟(jì)學(xué)與波斯納的法律的經(jīng)濟(jì)分析�？扑�1960年發(fā)表的《社會(huì)成本問題》是法律經(jīng)濟(jì)學(xué)的奠基之作。在1997年芝加哥法學(xué)院
[Abstract]:The law of positivism originates from the method of thinking from positivism to norm in law and economics. Based on Pierce's philosophy of pragmatism, and based on the classification of the types of legal effect, the author puts forward a new concept of law. This paper systematically constructs the legislative methods and judicial theories in the period of social transformation. There may be misunderstanding about legal economics by law people. The root of the misunderstanding lies in taking Posner's Economic Analysis of Law as the paradigm of legal economics. A distinction must be made between the economic analysis of Coase law and Posner's law. Coase's social costs, published on 1960, was the foundation of law and economics. Chicago law school, 1997
