【摘要】： 本文著眼于“約法三章”的解釋,盡筆者所能,結(jié)合簡牘、文獻(xiàn)所見的相關(guān)記載,以期把握“約法三章”的內(nèi)在特質(zhì)。具體地說,通過字面含義的解釋,弄清“約法三章”一詞的流變,從而更加清晰的認(rèn)識劉邦“約法三章”這一事件,并在此基礎(chǔ)上,聯(lián)系當(dāng)時(shí)的社會背景,結(jié)合出土的睡虎地秦簡和張家山漢簡的相關(guān)內(nèi)容,進(jìn)一步考證“三章”之法的具體律名。 文章由四個(gè)部分組成： 了解劉邦提出“約法三章”的歷史背景對我們理解并考證“約法三章”至關(guān)重要,基于此,筆者用大量篇幅來敘述劉邦提出“約法三章”的背景,并將此部分獨(dú)列一章放在全文開頭,是想起到強(qiáng)調(diào)的作用。 第二章主要探討“約法三章”的字面含義。通過對“約”、“法”和“三章”的考察,“約法三章”一詞的流變情況就會迎刃而解,從而,作為“約法三章”一詞的起源,劉邦提出“約法三章”這一歷史事件也將更加清晰。而“三章”之法作為“約法三章”的重要內(nèi)容,筆者也將在本章考察。 第三章主要聯(lián)系當(dāng)時(shí)的社會背景,并結(jié)合睡虎地秦簡和張家山漢簡的相關(guān)內(nèi)容,對“三章”之法的律名加以分析、篩選,從而找出劉邦與父老“約”的“三章”之法的具體內(nèi)容。 文章的最后主要論述劉邦“約法三章”的目的及意義。
[Abstract]:This paper focuses on the interpretation of the "three chapters of the contract Law", and tries its best to combine the relevant records of the Chien Bu and the literature, in order to grasp the inherent characteristics of the "three chapters of the contract Law". Specifically, through the interpretation of the literal meaning, To make clear the evolution of the word "three chapters of engagement Law", so as to understand more clearly the incident of Liu Bang's "three chapters of engagement Law", and on this basis, in connection with the social background at that time, combined with the relevant contents of Qin Jian and Zhang Jiashan Han Bamboo slips unearthed from the land of sleeping tigers, Further research on the specific name of the law of the three chapters. The article consists of four parts:. It is very important to understand the historical background of Liu Bang's "three chapters of engagement Law". Based on this, the author devoted a lot of space to describing the background of the "three chapters of engagement Law" put forward by Liu Bang. And this part of a separate chapter at the beginning of the full text, is to recall the role of emphasis. The second chapter mainly discusses the literal meaning of "three chapters of law". Through the investigation of "covenant", "law" and "three chapters", the evolution of the word "three chapters of law" will be solved easily, thus, as the origin of the word "three chapters of law", Liu Bang put forward that the historical event of "three chapters of law" will be clearer, and the law of "three chapters" as an important content of "three chapters of law" will also be examined in this chapter. The third chapter mainly relates to the social background at that time, and combines the relevant contents of Qin Jian and Zhangjiashan Han Bamboo slips to analyze and screen the law of "three chapters". In order to find out Liu Bang and father-old Treaty "three chapters" of the specific content of the law. The last part of the article mainly discusses the purpose and significance of Liu Bang's three chapters about Law.
