【摘要】： 為了打擊日益嚴峻的家庭暴力行為,南非在1998年通過了《家庭暴力法》。與此同時,南非還聲明要采取一切行動來消除針對女性的一切形式的歧視。因此本課題的主要研究對象是1998年的南非《家庭暴力法》。 首先是從南非《家庭暴力法》的立法背景與立法目的來對《家庭暴力法》展開闡述,其中南非《家庭暴力法》的立法背景包含了該法制定的社會背景,南非的社會背景表明南非《家庭暴力法》的出臺猶如一場及時雨,緩解了南非嚴峻的家庭暴力現(xiàn)狀。另外立法背景中還包含了法律背景,其中包括1993年的《防止家庭暴力法》和南非的《憲法權(quán)利草案》。除此以外,這一部分還介紹了南非《家庭暴力法》的立法目的主要是為了預防、打擊家庭暴力行為,為家庭暴力的受害者提供法律援助。 在介紹完《家庭暴力法》的立法背景與立法目的以后,筆者主要從實體法和程序法兩個方面來對《家庭暴力法》進行分析。其中針對實體法主要探討的問題包括當事人的權(quán)利義務、受害者的援助以及武器等規(guī)定,而針對程序法主要探討的是保護令的申請、簽發(fā)、變更與廢止以及法院的管轄權(quán)、刑期等問題。分析完《家庭暴力法》的內(nèi)容以后,最后提出了《家庭暴力法》的立法缺陷。雖然《家庭暴力法》從實體法與程序法兩個方面進行了全面的規(guī)定,但是還存在一定的立法缺陷,這種立法缺陷主要包括性暴力以及受害者援助這兩個方面的缺陷。所以筆者具體闡述了這兩種缺陷,并分別針對這兩種缺陷提出了相應的建設性方案。 總而言之,雖然南非《家庭暴力法》這部法律存在一定的缺陷,甚至在執(zhí)行的過程當中遇到了一些障礙,但給予了婦女一定程度上的保護,絲毫不影響南非保護婦女、消除對婦女一切形式歧視的堅定信念!
[Abstract]:In an effort to combat growing domestic violence, South Africa passed the domestic violence Act on 1998. At the same time, South Africa also stated that it would take all actions to eliminate all forms of discrimination against women. Therefore, the main subject of this study is the South African domestic violence Act of 1998. First of all, from the legislative background and legislative purpose of the domestic violence Act of South Africa, the legislative background of the domestic violence Act of South Africa includes the social background of the enactment of the Act. The social background of South Africa shows that the introduction of the domestic violence Act in South Africa is like a timely rain, which alleviates the severe situation of domestic violence in South Africa. In addition, the legislative background also contains the legal background. These include the Prevention of domestic violence Act of 1993 and the draft Constitutional Rights of South Africa. In addition to this section, the legislative purpose of the domestic violence Act in South Africa is mainly to prevent and combat domestic violence, Legal aid is provided to victims of domestic violence. After introducing the legislative background and purpose of the domestic violence Law, The author mainly analyzes the domestic violence Law from two aspects: substantive law and procedural law. The main issues discussed in substantive law include the rights and obligations of the parties, victim assistance and weapons, etc. In view of the procedural law, what is mainly discussed is the application for a protection order, the issuance of a protection order, the change and repeal of the law, the jurisdiction of the court, the sentence, and so on. After analyzing the contents of the domestic violence Law, Finally, the legislative defects of the domestic violence Law are put forward. Although the domestic violence Law has comprehensive provisions from the substantive law and the procedural law, there are still some legislative defects. This kind of legislation flaw mainly includes the sexual violence and the victim assistance these two aspects flaw, therefore the author elaborated these two kinds of defects in detail, and separately proposed the corresponding constructive plan to these two kinds of defects. All in all, although the South African domestic violence Act has certain shortcomings and even encountered some obstacles in the process of implementation, it gives women a certain degree of protection and does not in any way affect the protection of women in South Africa. Firm belief in the elimination of all forms of discrimination against women!
