榕江縣計劃鄉(xiāng)苗族習(xí)慣法與我國刑法關(guān)系研究

【摘要】:榕江縣計劃鄉(xiāng)地處貴州省月亮山腹地,計劃鄉(xiāng)苗族的歷史源遠(yuǎn)而流長。特殊的自然條件與特別的生產(chǎn)生活方式使得計劃鄉(xiāng)苗族的文化傳統(tǒng)深受原始宗教文化的影響,而作為文化傳統(tǒng)外化形成的習(xí)慣法同樣包含大量原始的內(nèi)容。對犯罪行為,,計劃鄉(xiāng)苗族社會擁有一套完整的立法、司法及執(zhí)法體系,體系中的三個層面均與我國刑法有著不同程度的沖突。盡管如此,當(dāng)?shù)孛缱辶?xí)慣法中積極的、與我國刑法價值追求相同的部分仍發(fā)揮著對刑法的補(bǔ)充作用。面對沖突,視我國刑法或苗族習(xí)慣法如草芥,棄其如敝履的做法尤不可取,尋求二者協(xié)調(diào)的路徑和方法實是調(diào)和兩者沖突的關(guān)鍵所在。本文分四個部分,共3萬余字。 本文第一部分主要對榕江縣計劃鄉(xiāng)一般情況、計劃鄉(xiāng)苗族習(xí)慣法的含義以及主要表現(xiàn)形式、當(dāng)?shù)孛缱逶甲诮涛幕尘斑M(jìn)行介紹,以此作為下文論述的基礎(chǔ)和鋪墊。 本文第二部分將田野調(diào)查中獲得的案例按照功能主義方法進(jìn)行分類描述,力求真實可靠、不參雜任何主觀臆斷。根據(jù)客觀詳實的案例,運用刑法學(xué)、法理學(xué)、法律人類學(xué)等學(xué)科的理論知識分析榕江縣計劃鄉(xiāng)苗族習(xí)慣法與我國刑法在法的適用、行為評價以及刑罰制度三個方面的沖突問題。 本文第三部分在總結(jié)前文案例的基礎(chǔ)上,分析榕江縣計劃鄉(xiāng)苗族習(xí)慣法在彌補(bǔ)我國刑法局限性,以及原始宗教文化與習(xí)慣法在犯罪預(yù)防方面對我國刑法的補(bǔ)充作用。 本文第四部分以前文所述榕江縣計劃鄉(xiāng)苗族習(xí)慣法與我國刑法的沖突和補(bǔ)充為基礎(chǔ),尋求二者相互協(xié)調(diào)的路徑,主要包括在一部分情況下,習(xí)慣法向我國刑法讓步,另外一部分情況下,我國刑法對計劃鄉(xiāng)苗族習(xí)慣法的吸收和融合兩個方面。
[Abstract]:Rongjiang County Planning Township is located in the hinterland of Yueliang Mountain in Guizhou Province, and the historical source of the Miao nationality in the Planning Township is far away and long. The special natural conditions and the special way of production and life make the cultural tradition of the Miao nationality in the Planning Township deeply influenced by the primitive religious culture. As a result of the externalization of cultural traditions, the customary law also contains a large number of primitive contents. For criminal acts, the Miao community in the planning township has a complete system of legislation, justice and law enforcement. The three levels of the system have different degrees of conflict with the criminal law of our country. Nevertheless, the positive part of the local customary law of the Miao nationality and the same part of the pursuit of the value of the criminal law of our country still play a complementary role to the criminal law. The criminal law or the customary law of the Miao nationality is regarded as grass mustard, but it is especially not advisable to abandon it. It is the key to reconcile the conflict between them by seeking the way and method of their coordination. This paper is divided into four parts, 30,000 words in all. The first part of this paper mainly introduces the general situation of Rongjiang County, the meaning and the main manifestation of the Miao customary law, as well as the original religious and cultural background of the local Miao nationality, as the basis and foundation of the following discussion. The second part of this paper classifies and describes the cases obtained in the field investigation according to the functionalism method, and tries to be true and reliable, and does not interfere with any subjective assumptions. According to the objective and detailed cases, the author applies criminal law and jurisprudence. Theoretical knowledge of legal Anthropology; the conflict between Miao customary Law and Criminal Law in Rongjiang County Planning Township and Criminal Law, behavior Evaluation and penalty system. The third part of this paper, on the basis of summing up the previous cases, analyzes the limitation of the Miao nationality customary law in Rongjiang County, and the supplementary role of the primitive religious culture and customary law to the criminal law of our country in the aspect of crime prevention. Based on the conflict and supplement of Miao customary law and criminal law in Rongjiang County, this article seeks the way of coordination between them, which mainly includes, in some cases, concessions from customary law to criminal law of our country. In the other part, the absorption and integration of the Miao customary law in the Criminal Law of the Planning Township.
